CITY COUNCIL MEETING
APRIL 20, 1992
April 16, 1992
TO: Mayor and Coun
FROM: City Manager
SUBJECT: Membership in Underground Services Alert
The State legislature has enacted laws requiring that all organizations with underground facilities, such as cities and counties, become members of an underground service alert organization. The purpose of the membership is to provide a contact for contractors, builders, maintenance personnel or individuals who are undertaking any underground work. These workers would contact the organization and notify them of the project. The organization would then contact all companies with underground facilities in the area of the project so that these companies can locate and protect their facilities. The overall goal of the organization is to provide safety in doing underground work.

The City Attorney' s Office has reviewed this matter and recommends the City apply for membership, in view of the fact that this is mandatory.

This matter has been discussed between Public Works staff and Underground Services Alert( USA) for some time. City staff has expressed concern about becoming a member and incurring costs outside of the budget process. USA officials indicate that they will not charge a membership fee until after July 1, 1992, so that these funds can be budgeted. Those numbers are currently being evaluated.

The regular monthly charges will not exceed$ 39.77 per month, plus an additional$ 1. 00 per facsimile transmission. These costs, too, will be included in the 1992- 93 budget for Council' s consideration.

It is recommended Council approve the attached application for membership in the Underground Service Alert (USA) program for an amount not to exceed$ 39.77 per month, plus$ 1. 00 per facsimile transmission, and authorize the Mayor to sign same.

MEMO
TO: DAVID JINKENS
FROM: MICHAEL BRINTON
SUBJECT: UNDERGROUND SERVICE ALERT
DATE: APRIL 15, 1992
A number of years ago Underground Service Alert (USA) was formed to provide a one telephone call information service for anyone that is undertaking any underground work. The USA territory is Northern California. Any contractors, builders, maintenance personnel, or individuals that are undertaking any underground work can call USA and notify them of the project. USA personnel then contacts all companies with any underground facilities in the area of the project so that these companies can locate and protect their facilities. The purpose of the organization is to provide safety in doing underground work.

The USA network extends into the City of Manteca, but the City has not been a member. A number of legal questions have been raised about the city' s liability in the past as part of this organization. There have also been concerns about the
installation and operation of equipment used to transmit messages.

The other organizations in the City with underground facilities such as Contel and P. G. & E. are currently members of USA.

The State Legislature has passed laws requiring that all organizations with underground facilities become members of the appropriate underground service alert organization. The Assistant City Attorney has reviewed the material and concluded that the city should become a member of the organization.

The manager of USA has contacted staff and stated that if we will become members that they will not charge any membership fee until after July 1 , 1992 after our budget for next year is in place. They have also decided that we can use our existing Fax equipment to obtain messages .

It is recommended that membership in USA be approved and that the Mayor be authorized to sign the appropriate documents. Funds for continuing operation of this service will be
included in the proposed budget.
