RESOLUTION 2023-XX
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA ACCEPTING THE 2023 AB481 ANNUAL REPORT IN ACCORDANCE WITH MANTECA MUNICIPAL CODE SECTION 2.40.030 WHEREAS, the City Council of the City of Manteca passed Ordinance Chapter
2.40.030 on April 5, 2022; and
WHEREAS, the Manteca Police Department (“Department”) submitted and posted an updated Manteca Police Department Military Equipment Funding, Acquisition and Use Policy (“Policy”), including an updated Equipment Inventory (“Inventory”) for 2023 on their website pursuant to Government Code Section 7072 on July 11, 2023. On the same date, the Department also posted the Manteca Police Department Military Equipment Report for 2022 (“2022 Report”), as required by Government Code Section 7072(a); and WHEREAS, on August 15, 2023 the Department presented the updated Policy and Inventory for 2023, the 2022 Report, and information from the community engagement meeting to the City Council at a regularly scheduled meeting, as required by Government Code section 7072(a); and WHEREAS, the City Council of the City of Manteca has reviewed the 2022 Report and the updated Policy for 2023; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council of the City of Manteca that the 2022 Report meets the requirements of California Government Code Section 7072(a).
Based on the 2022 Report, pursuant to Government Code Section 7071(e)(2) the City Council determines that each type of military equipment identified in the Report has complied with the standards for approval set forth in Government Code Section 7071(d).
The City Council has reviewed Ordinance 2.40.030, as required by Government Code Section 7071(e), and Ordinance 2.40.030 is hereby renewed.
This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 15th day of August, 2023 , by the following vote:
