RESOLUTION R2023-XX
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, APPROVING AN OVERALL DISADVANTAGED BUSINESS ENTERPRISE (DBE) THREE- YEAR GOAL FOR FEDERAL TRANSIT ADMINISTRATION FUNDED PROJECTS FOR FISICAL YEARS 2024- 2026 WHEREAS, Pursuant to Federal Regulation 49 CFR Part 26, Disadvantaged Business Enterprise (DBE), public agencies receiving Federal Transit Administration (FTA) funds are required to prepare a triennial goal for the participation of DBEs in federal-assisted contracts.; and WHEREAS, A 1.48% base figure goal was calculated for the next triennial period. The goal is primarily based on an availability analysis of DBEs relative to all firms available for identified contracting opportunities spanning the next three Federal fiscal years; and WHEREAS, pursuant to the Federal Code of Regulations, 49 CFR Part 26, as amended, and regulations promulgated thereunder, in order to be eligible for Federal funds, the City of Manteca is required to have a Federal Transit Administration (FTA) approved Disadvantaged Business Enterprise (DBE) three-year goal for Federal Fiscal Years 2023/24 through 2025/26; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
That a Disadvantaged Business Enterprise (DBE) overall goal is 1.48% of FTA funded contracting opportunities is hereby approved and adopted for Federal Fiscal years 2023-24 through 2025-26.
3. This Resolution shall take effect immediately upon adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 15th day of August, 2023, by the following vote:
