RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, ACCEPTING THE GRANT FROM THE CALIFORNIA HIGHWAY PATROL CANNABIS TAX FUND GRANT PROGRAM (CTFGP) IN THE AMOUNT OF $117,121 AND APPROPRIATE AS OUTLINED; ASSIGN A PROJECT NUMBER AND AMEND THE FISCAL YEAR 2023-24 CAPITAL IMPROVEMENT PLAN TO INCLUDE THE VEHICLE PURCHASE; AUTHORIZE THE CHIEF OF POLICE TO TAKE ALL NECESSARY STEPS TO EFFECTUATE THE AGREEMENT, INCLUDING ANY EXTENSIONS OR AMENDMENTS THEREOF WHEREAS, the City of Manteca desires to undertake the California Highway Patrol Cannabis Tax Fund Grant administered by the Department of the California Highway Patrol (hereafter referred to as “CA CHP”) in the amount of $117,121 for the project term of July 1, 2023 through June 30, 2024; and WHEREAS, the Manteca Police Department will use the grant funds to increase criminal enforcement of Driving Under the Influence (DUI) laws, increase traffic enforcement efforts for unsafe driving commonly associated with injury and fatal collisions and acquire police vehicles used by officers to enforce the afore-mention traffic laws; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct and establish the factual basis for the City Council’s adoption of this Resolution.
Accept the grant from the California Highway Patrol Cannabis Tax Fund Grant Program and appropriate funds as follows:
$117,121 to CHP Cannabis Grant (Revenue Account No. 150.11.00.200-4475.03) $59,088 to Overtime Account (Expense Account No. 150.11.00.200.5000.03) $50,933 to Capital Outlay-Major Vehicles (Expense Account No. 150.11.00.200-7000.02) $7,100 to Administrative Training/Conferences (Expense Account No. 150.11.00.200-6600.04) Amend the Capital Improvement Plan to include the vehicle purchase Assign a Capital Improvement Plan project number to the vehicle purchase Authorize the Chief of Police to execute a contract, including any extensions or amendments thereof, and any subsequent contract with the State in relation thereto pursuant with the Purchasing Policy.
The City Council agrees that any liability arising out of the performance of this contract, including civil court actions for damages, shall be the responsibility of the grant recipient and the authorizing agency. The State of California and CA CHP disclaim responsibility for any such liability.
The City Council agrees that this award is not subject to local hiring freezes.
This Resolution shall take effect immediately upon its adoption.
