RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, ACCEPTING A GRANT DEED FROM PARMVIR SINGH SIDHU FOR 696 SQUARE FEET OF REAL PROPERTY FOR RIGHT-OF-WAY PURPOSES AND AN ACCOMPANYING 2,320 SQUARE FOOT PUBLIC UTILITY EASEMENT ALONG A PORTION OF THE PROPERTY LOCATED AT 2190 W. YOSEMITE AVENUE WHEREAS, as a Condition of Approval for the Lot Line Adjustment to merge a portion of 2190 W. Yosemite Avenue with 2210 and 2226 W. Yosemite Avenue, the applicant is required to dedicate three feet of property to the City for right-of-way purposes and a ten-foot Public Utility Easement; and WHEREAS, the Owner of 2190 W. Yosemite Avenue, Parmvir Singh Sidhu, is offering for dedication the northern 3 feet of the property to the City and an accompanying 10-foot Public Utility Easement; and WHEREAS, this dedication will create a 73-foot half-width right-of-way on W. Yosemite Avenue which matches the right of way dedication on the only other developed parcel in the area at 2320 W. Yosemite; and WHEREAS, this dedication will allow the future construction of sidewalk to be entirely in the City’s right-of-way, and the ten-foot Public Utility Easement is consistent with City engineering standards that utilities can be located out of the public right of way and behind the sidewalk; and WHEREAS, the City Council has considered all information related to this matter as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council hereby accepts a Grant Deed from Parmvir Singh Sidhu, for 696 square feet of real property for right-of-way purposes and an accompanying 2,320 square foot Public Utility Easement along a portion of the property located at 2190 W. Yosemite Avenue.
3. The City Clerk is hereby instructed to record this Resolution and the Grant Deed with the San Joaquin County Recorder’s Office.
4. This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 15th day of August 2023, by the following vote:
