RESOLUTION R2023-XX
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, APPROVING A PARCEL MAP FOR DIAMOND GALAXY PARTNERS, LLC, LOCATED AT THE NORTHWEST CORNER OF S. AIRPORT WAY AND ATHERTON DRIVE (1527 S. AIRPORT WAY); AND ACCEPTING FOR PUBLIC USE THE OFFER OF DEDICATION OF ALL PUBLIC UTILITY EASEMENTS SHOWN ON THE PARCEL MAP WHEREAS, Diamond Galaxy Partners, LLC, a California Limited Liability Company, has presented to the City Council of the City of Manteca a Parcel Map for 1527 S. Airport Way for approval; and WHEREAS, on August 18, 2022, the Manteca Planning Commission held a Public Hearing and adopted Planning Commission Resolution No. 1609 which approved the Tentative Parcel Map, the Minor Use Permit, Site Plan, and Design Review Application; and WHEREAS, the Crossings Retail Center owner is seeking to subdivide the property into eight commercial parcels ranging in size from 0.39 acres to 4.61 acres; and WHEREAS, in accordance with the Conditions of Approval for the Tentative Parcel Map, the owners are offering a ten foot (10’) wide public utility easement along the S. Airport Way and along the Atherton Drive frontages for dedication to the City; and WHEREAS, the City Council has considered all information related to this matter as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
1. The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct and establish the factual basis for the City Council’s adoption of this Resolution.
2. The City Council hereby approves the Parcel Map for Diamond Galaxy Partners, LLC.
3. The City Council hereby accepts the ten (10’) wide public utility easement along the S. Airport Way and along the Atherton Drive frontages of the Parcel Map.
4. The City Council hereby authorizes the Mayor of the City of Manteca to sign the Parcel Map on behalf of the City of Manteca and authorizes the City Clerk to attest thereto and impress the official seal upon the same.
5. This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 15th day of August 2023, by the following vote:
