ORDINANCE O2023-XX
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, AMENDING FEES AND CHARGES FOR SOLID WASTE COLLECTION SERVICES WHEREAS, on June 20, 2023 the City Council received the City of Manteca Solid Waste Rate Study, dated March 6, 2023 (the “Rate Study”), and set August 15, 2023 as the date for a public hearing regarding the proposed increases to the solid waste collection service fees and charges; and WHEREAS, the City of Manteca provides solid waste services to all residences and businesses located within city limits. Per City Municipal Code, the city has exclusive right to provide solid waste services to all residences and businesses; and WHEREAS, the Rate Study provided findings and recommendations to revise the City’s fees and charges for the City to recover its costs of providing solid waste collection services to its residential and commercial customers, including fees to meet all the new mandates of Senate Bill 1383 (SB1383); and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meeting of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
THE CITY COUNCIL OF THE CITY OF MANTECA DOES ORDAIN AS FOLLOWS:
SECTION 1: Amendment. Manteca Municipal Code section FEE SCHEDULES – III. UTILITIES is hereby amended to read as follows:
1. The City Council is authorized pursuant to the California Health and Safety Code Section 5471 to prescribe, revise and collect rates and charges for solid waste collection services and facilities furnished by the City (the “Charges”).
2. The City Council wishes to establish the Charges as listed below.

3. The City caused a notice of the proposed Charges and of the time and place of the hearing to the owner of each parcel of real property to be charged (the “Identified Parcels”) or property tenant that is directly responsible for payment of the Charges (each a “Customer”).
4. On August 15, 2023 at the time and day set forth in the notice, the City Council conducted a hearing on the proposed Charges and heard and considered all objections and protests thereto.
5. At the close of the public hearing, the City Council determined that written protests against the proposed Charge were not presented by a majority of Customers.
SECTION 2: Severability. If any section, sub-section, subdivision, paragraph, clause or phrase in this Ordinance, or any part thereof, is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections or portions of this Ordinance or any part thereof. The City Council hereby declares that it would have passed each section, sub-section, subdivision, paragraph, sentence, clause or phrase of this Ordinance, irrespective of the fact that any one or more sections, sub-sections, subdivisions, paragraphs, sentences, clauses or phrases may be declared invalid or unconstitutional.
SECTION 3: Effective Date. This Ordinance shall become effective thirty (30) days following adoption.
