RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA ADOPT A RESOLUTION AUTHORIZING THE CITY MANAGE OR DESIGNEE TO SUBMIT APPLICATIONS TO THE PUBLIC UTILITIES COMMISSION FOR MODIFICATIONS TO THE RAILROAD CROSSING AT WOODWARD AVE AND AUSTIN ROAD, TO COMPLETE AND EXECUTE ALL ASSOCIATED DOCUMENTS, REQUIRED TO FACILITATE CONSTRUCTION OF THE STATE ROUTE 99/120 INTERCHANGE PROJECT, AND TAKE ALL APPROPRIATE ACTIONS NECESSARY TO CARRY OUT THE PURPOSE AND INTENT OF THE RESOLUTION WHEREAS, in 2015, the City collaborated with the San Joaquin Council of Governments (SJCOG) and Caltrans District 10 to complete the project study report for the State Route (SR) 99/120 interchange project (Project); and WHEREAS, the project will add new auxiliary lanes, upgrade existing bridges, construct additional connector lanes, ramp upgrades, new signals, and lighting; and WHEREAS, the project will provide traffic congestion relief and improve operations of the interchange; and WHEREAS, in 2019 the Project Initial Studies Mitigate Negative Declaration was prepared by Caltrans and SJCOG as part of the California Environmental Quality Act; and WHEREAS, in April 2022, Caltrans and SJCOG presented the final conceptual design of the Project to City Council; and WHEREAS, City Council approved a resolution authorizing the City Manager or designee to accept, execute, and record documents transferring real properties to be acquired by Caltrans and dedicated to City after project completion; and WHEREAS, currently the Project design is nearing completion and is planned to begin construction in Spring of 2024; and WHEREAS, with construction planned for 2024, securing permits and agreements from third party agencies, such as Union Pacific Railroad, California Public Utilities Commission, and Pacific Gas & Electric are on the critical path; and WHEREAS, any delay would result in a delay to the Project and the potential loss of previously secured State and Federal grants; and WHEREAS, as portions of the project occur within the City’s jurisdiction, City is required to be a party to the applications and agreements process; and WHEREAS, there have been no previous City Council items that authorizes staff to sign any applications or agreement with third party agencies to facilitate construction of the Project; and WHEREAS, the City Council has considered all information related to this matter as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council hereby authorizes the City Manager or designee to submit applications to the California Public Utilities Commission for modifications to the Union Pacific Railroad crossing at Woodward Ave and Austin Road.
The City Council hereby authorizes the City Manager or designee to complete and execute all associated documents, required to facilitate construction of the state route 99/120 interchange project and take all appropriate actions necessary to carry out the purpose and intent of the resolution.
This Resolution shall take effect immediately upon adoption.
