AMENDMENT TO THE CITY ATTORNEY CONTRACT BETWEEN THE
CITY OF MANTECA AND L. DAVID NEFOUSE
This Amendment (“Amendment”) to the contract between the City of Manteca and L. David Nefouse is made and entered into this 19th day of September, 2023, by and between Mr. L. David Nefouse (“Nefouse”) and the City of Manteca, a municipal corporation, by and through the City Council (“City”) (together the “Parties”).
RECITALS
A. WHEREAS, On February 1, 2021, the City of Manteca approved a contract for Nefouse to serve as City Attorney (the “Contract”); B. WHEREAS, Section 10(g) of the Contract allows the Parties to mutually agree to amend the Contract in writing; C. WHEREAS, the City desires to amend the Contract between the City and Nefouse.
NOW, THEREFORE, the Parties hereby agree as follows:
1. Section 3(a) of the Contract is hereby amended to read as follows:
“NEFOUSE’S compensation shall be $249,252.45 annually, with an effective date of October 1, 2023.”
2. Section 3(d) is deleted in its entirety and replaced with:
“Benefits for NEFOUSE shall be agreed to by NEFOUSE and the City Council and shall be consistent with the Summary of Benefits set out herein and attached.”
3. Section 4 is hereby amended as follows:
“Everyone one year, on or around July 1, the City Council shall conduct an evaluation of NEFOUSE’s performance.”
4. Except as otherwise provided in this Amendment, the Contract shall continue in full force and effect.

TO EFFECTUATE THIS AMENDMENT, each of the Parties has caused this contract to be executed by its duly authorized representative as of the date set forth in the introductory paragraph on page 1 above.
