ORDINANCE O2023-XX
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, AMENDING SECTIONS 2.20.040 AND 2.20.050 OF THE MANTECA MUNCIPAL CODE WHEREAS, the Manteca Municipal Code section 2.08.010 states the City Manager is appointed and removed by only the City Council. Section 2.09.020 states the City Attorney is also appointed and removed by only the City Council; and WHEREAS, these are the only two positions directly appointed and or removed by the City Council. All other positions are under the direction of the City Manager; and WHEREAS, in most other jurisdictions, the Fire Chief serves at the pleasure of the City Manager; and WHEREAS, making the requested changes will make the Municipal Code and City of Manteca Rules and Regulations align with all other employees and section 2.20.060 Fire Chief – Reports to City Manager; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meeting of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
THE CITY COUNCIL OF THE CITY OF MANTECA DOES ORDAIN AS FOLLOWS:
SECTION 1: Amendment. Manteca Municipal Code sections 2.20.040 – Fire Chief Appointment – Term and 2.20.050 – Fire Chief – Compensation and terms of employment, is hereby amended to read as follows:
2.20.040 Fire Chief—Appointment—Term.
The chief of the fire department shall be appointed by the City Manager. Employment of the chief may be terminated by the City Manager.
2.20.050 Fire Chief—Compensation and terms of employment.
The compensation and terms of the employment of the chief shall be fixed from time to time by the City of Manteca Rules and Regulations.
SECTION 2: Severability. If any section, sub-section, subdivision, paragraph, clause or phrase in this Ordinance, or any part thereof, is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections or portions of this Ordinance or any part thereof. The City Council hereby declares that it would have passed each section, sub-section, subdivision, paragraph, sentence, clause or phrase of this Ordinance, irrespective of the fact that any one or more sections, sub-sections, subdivisions, paragraphs, sentences, clauses or phrases may be declared invalid or unconstitutional.
SECTION 3: Effective Date. This Ordinance shall become effective thirty (30) days following adoption.
