RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA APPROVING A COOPERATIVE AGREEMENT WITH THE SAN JOAQUIN COUNCIL OF GOVERNMENTS FOR THE 99/120 INTERCHANGE PROJECT PHASE 1A; APPROVING THE PUBLIC HIGHWAY OVERPASS AGREEMENT AT AUSTIN ROAD AND PUBLIC HIGHWAY AT-GRADE CROSSING AGREEMENT AT WOODWARD ROAD WITH THE UNION PACIFIC RAILROAD COMPANY; APPROVING A COOPERATIVE AGREEMENT WITH THE SAN JOAQUIN COUNTY OF GOVERNMENTS FOR THE SEWER LINE EXTENSION IN WOODWARD AVENUE; AMEND THE FY 2023-24 CAPITAL IMPROVEMENT PLAN TO INCLUDE THE 99/120 INTERCHANGE PROJECT – WOODWARD SEWER LINE EXTENSION BETWEEN MOFFAT BOULEVARD AND ATHERTON DRIVE AND ASSIGN A PROJECT NUMBER; APPROPRIATE $300,000 FROM THE PFIP SEWER FUND ZONE 24 RESERVES TO THE PROJECT; AND (6) AUTHORIZING THE CITY MANAGER OR DESIGNEE TO APPLY FOR PERMITS, APPLY FOR STATE AND FEDERAL GRANTS, SOLICIT PROJECT FUNDING SUPPORT, AND EXECUTE ALL ASSOCIATED DOCUMENTS WHEREAS, in 2015, the City collaborated with the San Joaquin Council of Governments (SJCOG) and Caltrans District 10 to complete the project study report for the State Route (SR) 99/120 interchange project (Project); and WHEREAS, in 2019 the Project Initial Studies Mitigate Negative Declaration was prepared by Caltrans and SJCOG as part of the California Environmental Quality Act; and WHEREAS, the Project design is near completion and is currently planned for construction in Spring of 2024; and WHEREAS, with construction planned for 2024, securing permits and agreements from third party agencies, such as Union Pacific Rail Road, California Public Utilities Commission, and Pacific Gas & Electric are on the critical path; and WHEREAS, any delay would result in a delay to the Project and the potential loss of previously secured State and Federal grants; and WHEREAS, as portions of the project occur within the City’s jurisdiction, City is required to be a party to the applications and agreements process; and WHEREAS, the City Council has considered all information related to this matter as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council hereby approves a cooperative agreement with the San Joaquin Council of Governments for the 99/120 Interchange Project Phase 1A.
The City Council hereby approves the Public Highway Overpass Agreement at Austin Road and Public Highway At-grade Crossing Agreement at Woodward Road with the Union Pacific Railroad Company.
The City Council hereby approves a cooperative agreement with the San Joaquin County of Governments for the Sewer Line Extension in Woodward Avenue between Moffat Blvd. and Atherton Drive.
The City Council hereby amends the FY2023-24 Capital Improvement Program to include the 99/120 Interchange Project – Woodward Sewer Line Extension between Moffat Blvd. and Atherton Drive for a total project budget of $300,000.
The City Council hereby appropriates $300,000 from the PFIP Wastewater Zone 24 Reserves into the 99/120 Interchange Project – Woodward Sewer Line Extension between Moffat Blvd. and Atherton Drive.
The City Council hereby authorizes the City Manager or designee to apply for permits, apply for State and Federal grants, solicit project funding support, complete and execute all associated documents, and take all appropriate actions necessary to carry out the purpose and intent of the resolution.
This Resolution shall take effect immediately upon adoption.
