RESOLUTION APPROVING AMENDMENT NO. 1 TO THE IMPROVEMENT AGREEMENT FOR VILLA TICINO WEST UNIT NO. 2, TRACT 4116, MODIFYING SCHEDULE B, WATER DISTRIBUTION SYSTEM, TABLE 2: WATER DISTRIBUTION SYSTEM P.F.I.P. REIMBURSEMENT, DECREASING THE AMOUNT FROM $19,280.51 TO $19,278.84; ADDING SCHEDULE B, TRANSPORTATION SYSTEM, TABLE 1: TRANSPORTATION SYSTEM P.F.I.P. REIMBURSEMENT, IN THE AMOUNT OF $37,106.08 WHEREAS, on May 19, 2022, the City of Manteca and JEN California 23, LLC, entered into an Improvement Agreement for Villa Ticino West Unit No. 2, Tract 4116 (C2022-58) with an Estimated Total Cost of Improvements of $6,165,391.94; and WHEREAS, the Improvement Agreement for Villa Ticino West Unit No. 2, Tract 4116, Schedule B, identified $19,280.51 for Water Distribution System Improvements; and WHEREAS, the Improvement Agreement for Villa Ticino West Unit No. 2, Tract 4116, Schedule B, did not include Transportation System, Table 1: Transportation System P.F.I.P. Reimbursement; and since the time the Improvement Agreement was executed, median 8” curb and stamped & colored concrete were constructed with the median on Louise Avenue; both of these items are eligible for PFIP reimbursement in the amount of $37,106.08; and WHEREAS, the decrease in the amount for Water Distribution System, Table 2: Water Distribution System P.F.I.P. Reimbursement, from $19,280.51 to $19,278.84, is simply due to rounding of the quantity (lineal feet) of 12” water main times the unit cost.; and WHEREAS, in light of the previous recitals, the City of Manteca and JEN California 23, LLC, desire to amend the Improvement Agreement for the Villa Ticino West Unit No. 2, Tract 4116 (C2022-58); and WHEREAS, the City Council has considered all information related to this matter as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
1. The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct and establish the factual basis for the City Council’s adoption of this Resolution.
2. The City Council approves an amendment to the Improvement Agreement for Villa Ticino West Unit No. 2, Tract 4116, modifying SCHEDULE B, Water Distribution System, Table 2: Water Distribution System P.F.I.P. Reimbursement, decreasing the amount from $19,280.51 to $19,278.84; adding SCHEDULE B, Transportation System, Table 1: Transportation System P.F.I.P. Reimbursement, in the amount of $37,106.08
3. The City Council authorizes the City Manager to sign and take all necessary steps to effectuate the amendment.
4. This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 17th day of October 2023, by the following vote:
