AMENDMENT NO. 1 TO THE IMPROVEMENT
AGREEMENT FOR VILLA TICINO WEST UNIT NO. 2,
TRACT 4116, BETWEEN THE CITY OF MANTECA AND
JEN CALIFORNIA 23, LLC
This Amendment No. 1 (Amendment) to the Improvement Agreement for Villa Ticino West Unit No. 2, Tract 4116 (C2022-58) (Agreement), between the City of Manteca and JEN California 23, LLC, is made and entered into this ______ day of ________________ 2023, by and between the City of Manteca, a public body, corporate and politic (City) and JEN California 23, LLC, a California Limited Liability Company (Developer).
RECITALS
A. On May 19, 2022, the City of Manteca and JEN California 23, LLC, entered into an Improvement Agreement for Villa Ticino West Unit No. 2, Tract 4116 (C2022-58) with an Estimated Total Cost of Improvements of $6,165,391.94.
B. The Improvement Agreement for the Villa Ticino West Unit No. 2, Tract 4116 (C2022-58) included SCHEDULE B, PUBLIC FACILITIES IMPLEMENTATION PLAN (P.F.I.P.), that identified Credits and Reimbursements, including WATER DISTRIBUTION SYSTEM, Table 2: Water Distribution System P.F.I.P. Reimbursement.
C. The Improvement Agreement for the Villa Ticino West Unit No. 2, Tract 4116 (C2022-58) did not include TRANSPORTATION SYSTEM, Table 1: Transportation System P.F.I.P.
Reimbursement.
D. In accordance with the adopted Public Facilities Implementation Plan (PFIP), Developer constructed median 8” curbs and stamped & colored concrete in the median on Louise Avenue; both items are identified in the PFIP and are reimbursable.
E. In light of the previous Recitals, the City of Manteca and JEN California 23, LLC, desire to amend the Improvement Agreement for the Villa Ticino West Unit No. 2, Tract 4116 (C2022-58).
NOW THEREFORE, the City of Manteca and JEN California 23, LLC, hereby agree as follows:
1. SCHEDULE B, PUBLIC FACILITIES IMPLEMENTATION PLAN (P.F.I.P.), WATER DISTRIBUTION SYSTEM, Table 2.
SCHEDULE B, Water Distribution System, Table 2, Water Distribution System P.F.I.P.
Reimbursement, contained in the Improvement Agreement for the Villa Ticino West Unit No. 2, Tract 4116 (C2022-58) is deleted in its entirety and replaced by Exhibit A, SCHEDULE B, Water Distribution System, Table 2, Water Distribution System P.F.I.P.
Reimbursement, incorporated by reference and attached to this amendment.
2. SCHEDULE B, PUBLIC FACILITIES IMPLEMENTATION PLAN (P.F.I.P.), TRANSPORTATION SYSTEM, Table 1.

SCHEDULE B, Transportation System, Table 1, Transportation System PFIP Reimbursement, not included in the Improvement Agreement for the Villa Ticino West Unit No. 2, Tract 4116 (C2022-58) is added to Exhibit A, SCHEDULE B, Transportation System, Table 1, Transportation System PFIP Reimbursement, incorporated by reference and attached to this amendment.
3. Except as otherwise provided in this Amendment, the Improvement Agreement for Villa Ticino West Unit No. 2, Tract 4116 (C2022-58), between the City of Manteca and JEN California 23, LLC, shall continue in full force and effect.
