RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, APPROVING a two-year extension for THE approved 320 AIRPORT WAY tentative subdivision map (IS/MND prepared pursuant to CEQA (SCH# 2021120523)) (FIle No. SDX 23-87) WHEREAS, the Manteca City Council at their duly noticed public hearing on April 19, 2022, approved a Tentative Subdivision Map and Mitigated Negative for the 320 Airport Way Subdivision Project, filed by Michael Kiper with 320 Airport Way LLC. which is set to expire on April 19, 2024; and WHEREAS, the 320 Airport Way Tentative Subdivision Map is a Tentative Subdivision Map for 116 single-family attached duplexes located at 320 North Airport Way identified by Assessor’s Parcel Number (APN) 200-140-26; and WHEREAS, the applicant is requesting that the approved map be given a two year extension of the expiration, giving the map a new expiration date of November 7, 2025; and WHEREAS, Subdivision Map Act Section 66452.6(a) states that the expiration date of any tentative subdivision map for which a tentative map has been approved and has not yet expired shall be extended by 24 months; and WHEREAS, the project is found to be consistent with the overall policies of the Manteca General Plan, Subdivision Map Act findings, and Manteca Municipal Code as described in the City Council Staff Report dated November 7, 2022 and therefore may be extended in conformance with Subdivision Map Act Section 66452.6(a); and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
2. A Mitigated Negative Declaration (SCH #2021120523) was completed for this project, and it was found that although the proposed project could initially have a significant effect on the environment, mitigation measures have been placed as conditions on the project to reduce those impacts to a less than significant level, eliminating the need for further CEQA review.
3. The City Council hereby adopts, as its own, the findings required to extend the expiration date of the approved Tentative Subdivision Map under Municipal Code Section 16.09.040, findings for which are detailed in the City Council Staff Report (dated November 7, 2023), which is hereby incorporated by reference into this Resolution.
4. Based on the foregoing, the City Council hereby approved the extension of the expiration date of the 320 Airport Way Tentative Subdivision Map, attached hereto as Exhibit “A”, subject to all conditions attached hereto as Exhibit “B”.
5. This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 7th day of November, 2023, by the following vote:
