RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, APPROVING AMENDMENT NO. 1 TO THE MAIN STREET BIKE & PEDESTRIAN IMPROVEMENT PROJECT CIP NO. 20005 PROFESSIONAL SERVICES AGREEMENT WITH MARK THOMAS & COMPANY, INC. FOR AN AMOUNT NOT-TO-EXCEED $24,382.45; AMEND AND APPROVE THE PROJECT ELIGIBLE LIST FOR THE FISCAL YEAR 2023-2024 FUNDED BY SENATE BILL 1 (SB1); AND AUTHORIZING THE CITY MANAGER OR DESIGNEE TO TAKE ALL APPROPRIATE ACTIONS NECESSARY TO CARRY OUT THE PURPOSE AND INTENT OF THE RESOLUTION WHEREAS, the Highway Safety Improvement Program (HSIP) is a federal program that funds transportation-related safety projects; and WHEREAS, the Federal Highway Administration and California Department of Transportation awarded an HSIP Grant in the amount of $1,934,640 to the City of Manteca (City) for the Main Street Bike & Pedestrian Improvement Project CIP No. 20005 (Project), which includes design and construction of bike lanes, raised medians, pedestrian median fencing, enhanced pedestrian crossings, and traffic signal loop modifications along Main Street from Northgate Drive to Alameda Street; and WHEREAS, on September 27, 2023, City entered into an Agreement for Professional Services with Mark Thomas & Company, Inc. (Consultant) for the development of plans specifications and estimates (PS&E) for the Project in an amount not-to-exceed $303,818.02; and WHEREAS, during the initial project design, staff reviewed the recently approved Local Roadway Safety Plan (LRSP) and identified additional improvements required in the Project vicinity; and WHEREAS, staff asked Consultant to provide additional PS&E services for installation of Pedestrian Hybrid Beacons system at the Main Street/Edison Street intersection and reconstruction of curb ramps to comply with current American's with Disabilities Act standards identified in the LRSP; and WHEREAS, staff determined that it would be most economical and efficient to incorporate said improvements into the Consultant’s scope of work; and WHEREAS, staff has completed negotiations with Consultant for the additional scope of work; and WHEREAS, the additional scope of work qualifies for Senate Bill 1 (SB1), the Road Repair and Accountability Act of 2017; and WHEREAS, to utilize SB1 funding an amendment to list of SB1 projects is needed to include the following HSIP projects:

WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council hereby approves Amendment No. 1 to the Main Street Bike & Pedestrian Improvement Project CIP No. 20005 Professional Services Agreement with Mark Thomas & Company, Inc. for an amount not-to-exceed $24,382.45.
The City Council hereby amends the list of SB1 projects to include the following projects and approves the projects to receive Road Repair and Accountability Act funding and as shown on the SB1 Project Location attachment:

Yosemite Ave: Walnut Ave to Main Street Bike and pedestrian Improvement Project The City Council hereby authorizes amending CIP 20005 to include the additional appropriation of $24,382.45 to the project, for a total not-to-exceed amount of $2,173,982.45 and amend the FY 2023-24 Budget to add an appropriation of this amount to Account No. 420.00.00900-8150.46 (Capital Improvements-Transportation SB1 Projects).
The City Council hereby authorizes the City Manager or designee to execute the Amendment, apply for permits, apply for State and Federal grants, solicit project funding support, complete and execute all associated documents, and take all appropriate actions necessary to carry out the purpose and intent of the resolution.
This Resolution shall take effect immediately upon its adoption.
