RESOLUTION R2023-XXX
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, State of California, DETERMINING Overaa Construction as the lowest responsive and responsible bidder for CIP 22061 and CIP 22063; awarding the construction contract to Overaa construction in an amount not-to-exceed $4,010,720; amending CIP 22061 and CIP 22063 budgets to include additional appropriations; authorizing the City Manager or designee to execute the construction contract and amendments, approve change orders and task orders up to the approved contingencies, apply for permits, apply for State and Federal grants, solicit project funding support, complete and execute all associated documents.
WHEREAS, City Council approved the subject projects plans, specifications, engineer’s estimate (EE) of $2.2 million, environmental documents, and authorized a call to bids on September 19, 2023; and WHEREAS, three bids were received and opened on October 17, 2023 as follows:
Overaa Construction $3,581,000
GSE $3,625,500
TNT Industrial $3,625,700; and
WHEREAS, although the bids received were all above the EE, staff is confident that the bids were competitive as the difference between the lowest and highest bidder is only 1.2%; and WHEREAS, Overaa Construction has submitted the required bid bond, proof of general contractor’s license, signed bid documents, and addendums; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council hereby affirms Overaa Construction as the lowest responsive and responsible bidder for the subject projects, awards the construction contract to Overaa Construction in the amount of $3,581,000, and approves a construction contingency of 12% for a total not-to-exceed project cost of $4,010,720.
The City Council hereby amends the CIP 22061 budget to include an additional appropriation of $734,000 funded from Fund 640 – Sewer Operations & Maintenance fund balance to GL Account: 640.00.00.900-8050.10.
The City Council hereby amends the CIP 22063 budget to include an additional appropriation of $734,000 funded from Fund 640 – Sewer Operations & Maintenance fund balance to GL Account: 640.00.00.900-8050.10.
The City Council hereby authorizes the City Manager or designee to execute the construction contract and amendments, approve change orders and task orders up to the approved contingencies, apply for permits, apply for State and Federal grants, solicit project funding support, complete and execute all associated documents, and take all appropriate actions necessary to carry out the purpose and intent of the resolution.
This Resolution shall take effect immediately upon its adoption.
