RESOLUTION R2023-XX
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, authorizing the City Manager or designee to allocate remaining American Rescue Plan Act (ARPA) funds to Council-approved special projects, amend the Fiscal Year 2023-24 Budget and Capital Improvement Plan as necessary to include those projects, appropriatE budgets to the projects, and take any actions necessary to obligate any remaining ARPA funds WHEREAS, The American Rescue Plan Act (ARPA) of 2021 was a $1.9 trillion economic stimulus bill passed by the United States Congress and signed into law on March 11, 2021; and WHEREAS, The City of Manteca received ARPA funding, totaling $13.9 million, via two approximately equal installments in June of 2021 and in June 2022 totaling; and WHEREAS, During Fiscal Years 2021-22, 2022-23, and 2023-24, a total of $11.4 million of the City’s ARPA funds have been allocated to respond to public health, essential worker pay, infrastructure, and revenue replacement, leaving a remaining amount of $2.5 million that must be obligated by December 31, 2024; and WHEAEAS, On August 15, 2023, Council discussed potential priorities regarding the use of the remaining ARPA funding and were assigned an allotment; $700k to the Mayor, and $450k to each four councilmembers; and WHEAEAS, During the Special Meeting of the City Council on Wednesday, November 8, 2023, the City Council reviewed and discussed requests for allocating the remaining ARPA funds and ultimately determined a list of special projects as presented in Exhibit “A”; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution; and Authorize the City Manager or designee to allocate and spend ARPA funds toward the Council Special Projects as presented in Exhibit “A”, attached hereto and incorporated herein by reference; and Authorize the City Manager or designee to amend the Fiscal Year 2023-24 Budget ad Capital Improvement Plan to include the projects presented in Exhibit A and appropriate budgets to those projects; and Authorize the City Manager or designee to make budget adjustments, reallocations, transfers-ins, transfers-outs, or take any other action as necessary to appropriately capture and obligate all expenditures associated with the American Rescue Plan Act; and Authorize the City Manager or designee to re-appropriate any unspent ARPA funds within in any given fiscal year to subsequent fiscal year Budgets until December 31, 2024.
6. This Resolution shall take effect immediately upon adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 5th day of December, 2023, by the following vote:
