RESOLUTION R2023-XX
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, APPROVING THE MEMORANDUM OF UNDERSTANDING AND SALARY MATRIX FOR THE OPERATING ENGINEERS LOCAL UNION NO. 3 (OE3) THROUGH JUNE 30, 2026 WHEREAS, the City of Manteca has a memorandum of understanding with the Operating Engineers Local Union No. 3 (OE3); and WHEREAS, the memorandum of understanding expired on June 30, 2023; and WHEREAS, the City of Manteca and OE3 negotiated and agreed to a new contract; and
WHEREAS, the term of the new contract is July 1, 2023 through June 30, 2026; and
WHEREAS, a 2% COLA will be received by all job classifications in year one (July 1, 2023-June 30, 2024) effective the first pay period following contract ratification with no retroactive pay, a 2% COLA in year two (July 1, 2024-June 30, 2025) and a 3% COLA in year three (July 1, 2025-June 30, 2026); and WHEREAS, a one-time non-PERSable payment of $5,000 will be paid to members of this unit, utilizing American Rescue Plan Act (ARPA) Funds; and WHEREAS, Lead workers and Senior classifications holding water or waste water certificates can now earn certification pay; and WHEREAS, the City and Association agree to discuss a salary/wage reopener no later than March 2025; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
Approval of appropriating American Rescue Plan Act (ARPA) Funds of $640,000 from Fund 110 (COVID Relief Fund) to fund the agreed upon contract with the OE3.
Approval of additional appropriations totaling $198,912, payable from the General fund and other funds, to fund the additional incentives and benefits of the contract with OE3.
Approval of the OE3 Memorandum of Understanding effective July 1, 2023 - June 30, 2026.
Approval of the OE3 Salary Matrix effective December 1, 2023.
This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 5th day of December, 2023, by the following vote:
