RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, AWARDING THREE CANNABIS RETAIL BUSINESS PERMITS TO ________, _____________, AND _____________; SUBJECT TO MEETING ALL OF THE REQUIREMENTS AND REGULATIONS SET FORTH IN ORDINANCE NO. O2021-16 (TITLE 5 BUSINESS TAXES, LICENSES AND REGULATIONS, CHAPTER 5.64 CANNABIS BUSINESSES) WHEREAS, the City Council of the City of Manteca adopted a Cannabis Business Ordinance on December 21, 2021; and WHEREAS, the of Manteca Cannabis Business Ordinance became effective on January 21, 2022; and WHEREAS, the adopted ordinance allows for the selection of up to three retail cannabis businesses; and WHEREAS, on March 7, 2023 the City Council adopted Resolution No. R2023-30 authorizing and approving the application and selection process for cannabis retail business program permits; fee schedule; appellate fee under the Manteca Municipal Code Chapter 5.64 per Manteca Municipal Code Sections 5.64230(B) and 5.64.250(B)(6); the use of a hearing officer for appeals under Manteca Municipal Code Chapter 5.64 per Manteca Municipal Code Section 5.64.260(A)(1); and determining that the adoption of the fee schedule is exempt from review under CEQA pursuant to CEQA Guidelines Section 15061; and WHEREAS, from March 8, 2023 to May 8, 2023 the application period was open for retail cannabis business operations; and WHEREAS, a total of seven (7) Applications were submitted for retail cannabis business operations; and WHEREAS, HdL Companies reviewed, determined to be complete, and provided a scoring to all seven Applicants for Phases I and II of the Application process; and WHEREAS, all seven Applicants successfully completed Phase II of the Application Process, wherein HdL reviewed the applications in accordance with Criteria A-D of the Application procedures; and WHEREAS, a Staff Selection Committee conducted merit-based interviews ON DATE, of all seven (7) applicants as all seven applicants (7) were deemed to have sufficiently completed Phases I and II; and WHEREAS, following the Phase III merit-based interviews, Applicants were notified of who would proceed to Phase IV and present to City Council; and WHEREAS on November 8, 2023, the City completed the Phase III appeal process for applicants who would not be advancing to Phase IV; and WHEREAS, the top four applicants had the opportunity to present to the City Council (Phase IV); and WHEREAS, the City Council of the City of Manteca has the authority to determine the three applicants who appear to best meet the needs of the community; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
1. The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
2. The City Council finds and determines that the number of permits to be issued in the City for the City’s Retail Cannabis Program is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3) of the CEQA Guidelines.
3. Approve the award of cannabis business permits to ___________, __________, and __________; subject to meeting all of the requirements and regulations set forth in Ordinance No. O2021-16- (Title 5 Business Taxes, Licenses and Regulations, Chapter 5.64 Cannabis Businesses).
2. This Resolution shall take effect immediately upon adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 18th day of December, 2023, by the following vote:
