RESOLUTION R2023-XX
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, ACCEPTING A GRANT OF PUBLIC UTILITY EASEMENT FROM JEN CALIFORNIA 23 LLC FOR AN 8,712 SQUARE FOOT PUBLIC UTILITY EASEMENT ALONG A PORTION OF THE PROPERTY ADJACENT TO VILLA TICINO WEST UNIT 3 WHEREAS, as part of the coordination for the joint trench utilities installation with Villa Ticino West Unit 3, the Grantor is dedicating to the City a 10-foot Public Utility Easement along a portion of the property adjacent to Villa Ticino West Unit 3; and WHEREAS, the Grantor of Villa Ticino West Unit 3, JEN California 23 LLC, is offering for dedication a 10-foot Public Utility Easement; and WHEREAS, the 10-foot Public Utility Easement is consistent with City engineering standards that utilities can be located out of the public right of way and behind the sidewalk; and WHEREAS, the City Council has considered all information related to this matter as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council hereby accepts a Grant of Public Utility Easement from JEN California 23 LLC, an 8,712 square foot Public Utility Easement along a portion of the property adjacent to Villa Ticino West Unit 3.
3. The City Clerk is hereby instructed to record this Resolution and the Grant Deed with the San Joaquin County Recorder’s Office.
4. This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 19th day of December 2023, by the following vote:
