RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, ACCEPTING A GRANT FROM THE CALIFORNIA OFFICE OF TRAFFIC SAFETY (OTS) FOR THE GRANT ASSISTANCE PROGRAM FOR FISCAL YEAR 2023-2024; APPROVING THE AGREEMENT WITH OTS; AUTHORIZING THE CHIEF OF POLICE TO EXECUTE THE AGREEMENT AND APPROVE A BUDGET APPROPRIATION OF $120,000 WHEREAS, the City of Manteca desires to undertake the Selective Traffic Enforcement Program (S.T.E.P.) Grant administered by the California Office of Traffic Safety hereafter referred to as “CA OTS” in the amount of $120,000 for the project term of October 1, 2023 through September 30, 2024 (Federal Fiscal Year 2024); and WHEREAS, the Manteca Police Department will use the grant funds to increase criminal enforcement of Driving Under the Influence (DUI) laws and increase traffic enforcement operations for unsafe driving commonly associated with injury and fatal collisions in addition to the receipt of traffic safety equipment; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council of the City of Manteca accepts the Selective Traffic Enforcement Program (S.T.E.P) Grant administered by the CA OTS and approves the agreement associated with the grant activities.
The City Council agrees that the Chief of Police of the City of Manteca is authorized to execute on behalf of the City Council a contract, including any extensions or amendments thereof and any subsequent contract with the State in relation thereto.
The City Council agrees that any liability arising out of the performance of this contract, including civil court actions for damages, shall be the responsibility of the grant recipient and the authorizing agency. The State of California and CA OTS disclaim responsibility for any such liability.
The City Council agrees that this award is not subject to local hiring freezes.
Appropriates $120,000 in revenue to the Police Grants Fund Intergovernmental Grants – Federal Office of Traffic Safety (Account No. 150.11.00.900-4450.23).
Appropriates $99,523 to the Police Grants Fund - Salaries Overtime (Account No. 150.11.00.200-5000.03).
Appropriates $18,260 to the Police Grants Fund - Supplies Police OTS (Account No. 150.11.00.200-6210.14).
Appropriates $2,217 to the Police Grants Fund - Administrative Expenses Training / Conferences (Account No. 150.11.00.200-6600.04).
This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 16th day of January, 2024, by the following vote:
