RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, APPROVING A DISPOSITION AND DEVELOPMENT AGREEMENT FOR THE SALE OF REAL PROPERTY LOCATED AT 1181 MILO CANDINI DR FOR THE DEVELOPMENT OF A BREWERY WHEREAS, the City of Manteca (“City”) is the owner of .67-acres or 29,118 square feet, more or less, located at 1181 Milo Candini Dr. in the City of Manteca, California (“Property”); and WHEREAS, the City and Kevin Youkilis (“Developer”) propose to enter into that certain Development and Disposition Agreement (“DDA”) presented to the Manteca City Council this date, pursuant to which DDA the City will sell the Property to Developer for development in accordance with the terms of the DDA (the “Project”); and WHEREAS, at the May 19, 2022 Planning Commission meeting, the City of Manteca Planning Commission determined Developer’s development project to be categorically exempt from the requirement of the California Environmental Quality Act (“CEQA”) per Article 19, Class 32, “In-Fill Development Projects”; and WHEREAS, at the same May 19, 2022 the City of Manteca Planning Commission approved Developer’s development project and determined, in accordance with government Code section 65402, that Developer’s project is consistent with the City of Manteca’s General Plan land use designation, and is a permitted use under the Master Plan Zoning designation of the site, making Developer’s development project consistent with the current and planned use of the Property; and WHEREAS, on July 21, 2020, the City of Manteca City Council declared the property surplus, published the required notice of availability (“NOA”) on July 11, 2023, and received a formal letter of compliance to the Surplus Land Act (“SLA”) from the California Housing and Community Development Department; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council hereby approves a Development and Disposition Agreement (“DDA”) with Kevin Youkilis (“Developer”) for the sale of real property located at 1181 Milo Candini Dr. for the development of a brewery.
The City Council hereby authorizes the Mayor to sign the DDA.
The City Council hereby authorizes the City Manager or designee to sign all documents necessary to effectuate the DDA, and take all appropriate actions necessary to carry out the purpose and intent of the resolution.
This Resolution shall take effect on the effective date immediately.
