RESOLUTION R2024-XX
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, APPROVING THE SIDE LETTER BETWEEN THE OPERATING ENGINEERINGS LOCAL UNION NO. 3 (oe3) AND UPDATED SALARY MATRIXS FOR THE mANTECA tECHNICAL SUPPORT ASSOCIATION (mtssa) AND mID MANAGEMENT ASSOCIATION (MMA) WHEREAS, the Parties have previously entered into a Memorandum of Understanding (“MOU”), which was adopted pursuant to Resolution No. R2023-166 and has an effective term from July 1, 2023-June 30, 2026; and WHEREAS, Section 42 of this agreement contained a provision for Flex Staffing. Flex Staffing allows an Operator I to advance to an Operator II and Operator II to an Operator III after they demonstrate specific proficiency on City equipment; and WHEREAS, the language included in the agreement required the Operator I to be proficient in four out of five pieces of equipment (roll off, side loader, front loader, sweeper and food waste separator) in order to move from an Operator I to Operator II; and WHEREAS, this language should have stated that the operator needed to be proficient in three out of five pieces of equipment to qualify for Operator II; and WHEREAS, the language included in the agreement required the Operator II to be proficient in all five pieces of equipment (roll off, side loader, front loader, sweeper and food waste separator) in order to move from an Operator II to Operator III; and WHEREAS, this language should have stated that the operator needed to be proficient in four out of five pieces of equipment to qualify for Operator III; and WHEREAS, the City now agrees to amend the Flex Staffing set forth in section and will include this language in the future adopted MOU; and WHEREAS, the City Council previously approved the MTSSA salary matrix on October 17, 2023 that included errors to the Engineering positions; and WHEREAS, the corrections have been made to the MTSSA salary matrix and are effective October 17, 2023; and WHEREAS, the City Council previously approved the MMA salary matrix with errors to the Engineering positions, Deputy Director of Maintenance & Operations and Senior Accountant salary range; and WHEREAS, the corrections have been made to the MMA salary matrix and are effective November 7, 2023; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council of the City of Manteca does hereby approve the OE3 Side Letter of Agreement shown as Exhibit “A.”
2. The City Council of the City of Manteca does hereby approve the MTSSA salary matrix shown as Exhibit “B.”
3. The City Council of the City of Manteca does hereby approve the MMA salary matrix shown as Exhibit “C.”
3. This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 20th day of February, 2024, by the following vote:
