RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, APPROVING A DISPOSITION AND DEVELOPMENT AGREEMENT FOR THE SALE OF REAL PROPERTY LOCATED AT 309 WEST YOSEMITE AVENUE AND 105 SYCAMORE AVENUE WHEREAS, the City of Manteca (“City”) is the owner of .22-acres or 9,750 square feet, more or less, located at 309 West Yosemite Avenue and 105 Sycamore Avenue in the City of Manteca, California (“Properties”); and WHEREAS, the City and Delta Community Developers Corp., (“Developer”) propose to enter into that certain Development and Disposition Agreement (“DDA”) presented to the Manteca City Council this date, pursuant to which DDA the City will sell the Property to Developer for development in accordance with the terms of the DDA (the “Project”); and WHEREAS, on December 6, 2022, the City of Manteca City Council declared the property surplus, published the required Notice of Availability (“NOA”) on December7, 2022 and February 1, 2023; and WHEREAS, the City received one response to the NOA that included affordable housing; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council hereby approves a Development and Disposition Agreement (“DDA”) with Delta Community Developers Corp. (“Developer”) for the sale of real property located at 309 West Yosemite Avenue and 105 Sycamore Avenue, for the development of an Affordable Housing Project.
The City Council hereby authorizes the Mayor to sign the DDA.
The City Council hereby authorizes the City Manager or designee to sign all documents necessary to effectuate the DDA, and take all appropriate actions necessary to carry out the purpose and intent of the resolution.
This Resolution shall take effect on the effective date immediately.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 28th day of February, 2024, by the following vote:
