RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, DETERMINING UNITED PAVEMENT MAINTENANCE, INC. AS THE LOWEST, RESPONSIVE, AND RESPONSIBLE BIDDER FOR THE LOUISE AVENUE (MAIN STREET TO HIGHWAY 99) PAVEMENT IMPROVEMENT PROJECT CIP 24112 IN THE AMOUNT OF $2,240,818; AWARDING THE CONSTRUCTION CONTRACT TO THE LOWEST, RESPONSIVE, AND RESPONSIBLE BIDDER; APPROVING AN AGREEMENT FOR SERVICES WITH TRC ENGINEERS, INC. TO PROVIDE CONSTRUCTION MANAGEMENT AND INSPECTION SERVICES IN AN AMOUNT NOT-TO-EXCEED $305,233.15; APPROVING A TOTAL PROJECT CONTINGENCY OF $330,000; APPROPRIATING $2,876,052 IN MEASURE K FUNDING TO CIP 24112 AND THEREBY AMENDING THE FISCAL YEAR 2023-2024 BUDGET AND CAPITAL IMPROVEMENT PROGRAM; AND AUTHORIZING THE CITY MANAGER OR DESIGNEE TO TAKE ALL APPROPRIATE ACTIONS NECESSARY TO CARRY OUT THE PURPOSE AND INTENT OF THE RESOLUTION WHEREAS, the Louise Avenue (Main Street to Highway 99) Pavement Improvement Project CIP 24112 (Project) entails grinding and removing the existing asphalt, amending and recompacting the aggregate base, installing new asphalt, updating signage, striping and pavement markings, installation of bike lanes, and improving pedestrian access; and WHEREAS, the 2019 Measure K Renewal Strategic Plan identifies the following arterial projects being sponsored by the City of Manteca:
RA18, SR 120/McKinley Avenue Interchange Improvements (in Construction) RA20, Louise Avenue Improvements (the Project)
RA21, SR 120/Main Street Interchange Improvements (in Project Study Report phase) RA22, SR 120/Airport Way Interchange Improvements (in Project Study Report phase) RA23, SR 120/Union Road Interchange Improvements (Completed); and WHEREAS, the Project qualifies for funding by Measure K; and WHEREAS, the Project Plans and Specifications were approved and authorized to bid by the City Council on February 20, 2024; and WHEREAS, on February 23, 2024, the Project was advertised for bid, and a mandatory job walk was held on March 7, 2024.
WHEREAS, responses to questions received were published on the City’s website on March 14, 2024; and WHEREAS, on March 21, 2024, the City received bids from the following firms:
United Pavement Maintenance, Inc. $2,240,818
Mountain Cascade Inc. $2,259,441
George Reed, Inc. $2,472,900
Tracy Grading & Paving Inc. $2,574,950
Tom Mayo Construction Inc. $2,812,225
McGuire & Hester $3,105,495
B&M Builders, Inc. $3,795,025; and
WHEREAS, on March 7, 2024, the City issued a Request for Proposals (RFP) for Construction Management & Inspection Services for the Project; and WHEREAS, responses to questions/inquiries received were published on the City’s website on March 14, 2024; and WHEREAS, on March 21, 2024, the City received proposals from the following firms:
Blackburn Consulting, Inc.
Dewberry Engineers, Inc.
Gannett Fleming, Inc.
SJ Construction Management
SNG & Associates, Inc.
TRC Engineers, Inc.; and
WHEREAS, the City established an evaluation committee consisting of three (3) City staff to evaluate and rank all the received proposals based on the advertised criteria; and WHEREAS, based on experience, qualifications and scope of works included in the proposal, the evaluation committee concluded that TRC Engineers, Inc. (Consultant) was the most responsible, responsive, qualified firm, and best meets the specific goals of the Project; and WHEREAS, staff has completed cost negotiations with Consultant for an amount not-to-exceed $305,233.15; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council hereby determines United Pavement Maintenance, Inc. as the lowest, responsive, and responsible bidder for the Louise Avenue (Main Street to Highway 99) Pavement Improvement Project CIP 24112 in the amount of $2,240,818.
The City Council hereby awards the construction contract to the lowest, responsive, and responsible bidder.
The City Council hereby approves an Agreement for Services with TRC Engineers, Inc. to provide construction management and inspection services in an amount not-to-exceed $305,233.15.
The City Council hereby approves a total project contingency of $330,000 for any project related costs.
The City Council hereby amends the fiscal year 2023-2024 Budget and Capital Improvement Program by appropriating $2,876,052 in Measure K funding to CIP 24112.
The City Council hereby authorizes the City Manager or designee to take all appropriate actions necessary to carry out the purpose and intent of this resolution, including but not limited to: approving construction change order(s), approving agreement amendments, approving expenditures for project related costs up to the total project contingency, apply for permits, apply for State and Federal grants, solicit project funding support, and complete and execute all associated documents.
This Resolution shall take effect immediately upon its adoption.
