RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, DETERMINING KNIFE RIVER CONSTRUCTION AS THE LOWEST, RESPONSIVE, AND RESPONSIBLE BIDDER FOR THE LATHROP ROAD PAVEMENT IMPROVEMENT PROJECT CIP 24111; AWARDING THE PROJECT CONSTRUCTION CONTRACT TO CONTRACTOR IN THE AMOUNT OF $1,874,525; APPROVING AN AGREEMENT FOR SERVICES WITH DEWBERRY ENGINEERS, INC. TO PROVIDE CONSTRUCTION MANAGEMENT AND INSPECTION SERVICES FOR THE PROJECT IN AN AMOUNT NOT-TO-EXCEED $249,283; APPROVING A PROJECT BUDGET CONTINGENCY OF $300,000 FOR A TOTAL PROJECT BUDGET OF $2,423,808; AND AUTHORIZING THE CITY MANAGER OR DESIGNEE TO EXECUTE THE CONSTRUCTION CONTRACT, AGREEMENT FOR SERVICES, APPROVE CONSTRUCTION CHANGE ORDERS AND AGREEMENT AMENDMENTS UP TO THE TOTAL PROJECT BUDGET, AND TAKE ALL APPROPRIATE ACTIONS NECESSARY TO CARRY OUT THE PURPOSE AND INTENT OF THE RESOLUTION WHEREAS, the Lathrop Road (Union Road to Highway 99) Pavement Improvement Project CIP 24111 (Project) entails grinding and removing the existing asphalt where surface failure is prevalent, removing the entire asphalt sections where base failure is visible, amending and recompacting the aggregate base, installing new asphalt, updating signage, striping and pavement markings, and Americans with Disabilities Act curb ramps; and WHEREAS, the Project was approved and authorized to bid by the City Council on May 21, 2024; and WHEREAS, on May 23, 2024, the Project was advertised for bid, and a mandatory job walk was held on June 3, 2024. The deadline to submit questions and/or inquiries was on June 4, 2024, and responses to questions/inquiries received prior to the deadline were published on the City’s website on June 5, 2024; and WHEREAS, six bids were received and opened on June 10, 2024:

Mountain Cascade, Inc. $2,450,471
Dirt Dynasty, Inc. $2,585,040; and
WHEREAS, on May 23, 2024, the City issued a Request for Proposals (RFP) for Construction Management & Inspection Services for the Project. The deadline to submit questions and/or inquiries was on June 4, 2024, and responses to questions/inquiries received prior to the deadline were published on the City’s website on June 5, 2024; and WHEREAS, on June 10, 2024, the City received proposals from three firms:
Dewberry Engineers, Inc.
SNG & Associates, Inc.
TRC Engineers, Inc.; and
WHEREAS, the City established an evaluation committee consisting of three (3) City staff to evaluate and rank all the received proposals based on the advertised criteria; and WHEREAS, based on qualification and scope of works, the evaluation committee concluded that Dewberry Engineers, Inc. (Consultant) is the most responsible, responsive, qualified firm, and meets the specific goals of the Project. Staff has completed cost negotiations with Consultant for an amount not-to-exceed $249,283; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establishes the factual basis for the City Council’s adoption of this Resolution.
The City Council hereby determines Knife River Construction as the lowest, responsive, and responsible bidder for the Project.
The City Council hereby awards the Project construction contract to Knife River Construction in the amount of $1,874,525.
The City Council hereby approves an Agreement for Services with Dewberry Engineers, Inc. to provide construction management and inspection services for the Project in an amount not-to-exceed $249,283.
The City Council hereby approves a Project contingency of $300,000 for a total Project budget of $2,423,808.
The City Council hereby authorizes the City Manager or designee to execute the construction contract, Agreement for Services, approve construction change orders and Agreement amendments up to the total Project budget, apply for permits, apply for State and Federal grants, solicit project funding support, complete and execute all associated documents, and take all appropriate actions necessary to carry out the purpose and intent of the resolution.
This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 18th day of June, 2024, by the following vote:
