AMENDMENT TO THE CITY ATTORNEY CONTRACT AND SUMMARY OF BENEFITS BETWEEN THE CITY OF MANTECA AND L. DAVID NEFOUSE
This Amendment (“Amendment”) to the contract between the City of Manteca and L. David Nefouse is made and entered into this 18th day of June, 2024 by and between Mr. L. David Nefouse (“Nefouse”) and the City of Manteca, a municipal corporation, by and through the City Council (“City”) (together the “Parties”).
RECITALS
A. WHEREAS, effective February 1, 2021, the City of Manteca entered into a contract for Nefouse to serve as City Attorney (the “Contract”); B. WHEREAS, Section 10(g) of the Contract allows the Parties to mutually agree to amend the Contract in writing; C. WHEREAS, the City desires to amend the Contract between the City and Nefouse.
NOW, THEREFORE, the Parties hereby agree as follows:
1. Section 3(a) of the Contract is hereby amended to read as follows:
“NEFOUSE’S compensation shall be $254,237.50 annually, with an effective date of July 1, 2024.
NEFOUSE’S compensation shall be $261,864.63 annually, with an effective date of July 1, 2025.
NEFOUSE’S compensation shall be $269,720.57 annually, with an effective date of July 1, 2026.”
2. Section 3(e) of the Contract is hereby amended to read as follows:
“NEFOUSE shall receive a monthly vehicle allowance of $500 for the use of his personal vehicle for all CITY business and related travel, and all other business purposes.”
3. In the Summary of Benefits for NEFOUSE, the following adjustments and additions shall be made:
Administrative Leave
Increase annual hours received from 120 to 140; increase the cap of administrative leave from 300 hours to 320 hours; and increase the annual cash out amount from 80 hours to 120 hours.
Wellness Benefit
NEFOUSE shall receive a monthly wellness benefit of $100.
4. Except as otherwise provided in this Amendment, the Contract and Summary of Benefits shall continue in full force and effect.
TO EFFECTUATE THIS AMENDMENT, each of the Parties has caused this contract to be executed by its duly authorized representative as of the date set forth in the introductory paragraph on page 1 above.
