RESOLUTION R2024-XX
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, APPROVING THE SETTLEMENT AGREEMENT BETWEEN THE CITY OF MANTECA AND THE MANTECA FIREFIGHTERS, IAFF LOCAL 1874 REGARDING COMPENSATION AND FAIR LABOR STANDARDS ACT (FLSA) CALCULATIONS FOR FISCAL YEARS 2021/2022 AND 2022/2023 WHEREAS, Local 1874 filed a grievance on June 29, 2023 regarding compensation incentives and FLSA calculations pursuant to Section II, subsection 11 of the parties’ Memorandum of Understanding; WHEREAS, the Human Resources and Payroll Department subsequently conducted audits of compensation for Local 1874 members for Fiscal Years 2021/22 and 2022/23; and WHEREAS, it was determined that forty-three (43) Local 1874 members, actively employed as of May 1, 2024, are owed retroactive amounts based on the audit; and WHEREAS, the total financial impact of the amounts is $346,032.20, of which $124,551.64 is Measure M, and $221,480.56 is General Fund, based on personnel labor cost allocations.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby approves the settlement agreement, attached hereto as Attachment 2.
The City Council hereby approves the total financial impact of $346,032.20 ($124,551.64 Measure M; and $221,480.56 General Fund), as reported hereto as Attachment 3.
The City Council hereby authorizes the City Manager to carry out the intention of the settlement agreement and make budget appropriations to Fiscal Year budget 2024/25 as needed to cover the settlement cost as set out herein, and execute any and all agreements and/or amendments necessary to facilitate the terms of the settlement agreement.
4. This Resolution shall take effect immediately upon adoption.
