RESOLUTION APPROVING AMENDMENT No. 1 TO THE IMPROVEMENT AGREEMENT FOR THE MANTECA MEDICAL BUILDING, MODIFYING SCHEDULE B, TABLE 1, TRANSPORTATION SYSTEM PFIP REIMBURSEMENT, INCREASING THE AMOUNT LISTED AS TOTAL TRANSPORTATION FACILITIES PFIP REIMBURSEMENT FROM $442,433 TO $485,222; AND AUTHORIZING THE CITY MANAGER TO SIGN AND TAKE ALL NECESSARY STEPS TO EFFECTUATE THE AMENDMENT WHEREAS, on November 22, 2022, the City of Manteca and MPVCA Manteca, LLC, entered into an Improvement Agreement for the Manteca Medical Building (C2022-175) with the Estimated Total Cost of Improvements of $837,932; and WHEREAS, that portion of the Manteca Medical Building improvement plans widening N. Airport Way and W. Yosemite Avenue along the project’s frontages did not include certain necessary Transportation System PFIP improvements; and WHEREAS, the necessary improvements along the widenings were constructed, including additional work to correctly install the needed pavement section and the median; additional signage, striping and delineators; and the adjustment of a monitoring well; and WHEREAS, in light of the previous recitals, the City of Manteca and MPVCA Manteca, LLC, desire to amend the Improvement Agreement for the Manteca Medical Building (C2022-175) to include the cost of the additional work in SCHEDULE B, Table 1, Transportation System PFIP Reimbursement total; and WHEREAS, the City Council has considered all information related to this matter as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
1. The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct and establish the factual basis for the City Council’s adoption of this Resolution.
2. The City Council approves Amendment No. 1 to the Improvement Agreement for the Manteca Medical Building, modifying SCHEDULE B, Table 1, Transportation System PFIP Reimbursement, increasing the Total Transportation Facilities Systems PFIP Reimbursement amount from $442,433 to $485,222.
3. The City Council authorizes the City Manager to sign and take all necessary steps to effectuate the amendment.
4. This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 20th day of August 2024, by the following vote:
