RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA APPROVING AMENDMENT NO. 2 TO PROFESSIONAL SERVICES AGREEMENT WITH WOOD RODGERS, INCORPORATED FOR THE NILE GARDEN WELL 30 WATER SUPPLY PROJECT; EXTENDING THE TIME OF PERFORMANCE TO DECEMBER 31, 2025; INCREASING THE MAXIMUM NOT TO EXCEED COMPENSATION BY $200,000 FOR A TOTAL NOT TO EXCEED OF $715,947; AND AUTHORIZE THE CITY MANAGER OR DESIGNEE TO TAKE ALL APPROPRIATE ACTIONS NECESSARY TO CARRY OUT THE PURPOSE AND INTENT OF THE RESOLUTION WHEREAS, the City of Manteca (City) and the Manteca Unified School District (MUSD) collaborated to secure a $8.37 million grant from the State Water Resources Control Board (SWRCB) to construct Well 30 and all ancillary equipment needed to provide drinking water to Nile Garden Elementary School as part of the Nile Garden Well 30 Water Supply Project CIP 21026 and 21034 (Project); and WHEREAS, the Project is comprised of two phases. Phase 1 Drilling, includes the drilling of Well 30. Phase 2 Equipping, includes the installation of the well pump, building, ancillary equipment, arsenic treatment system, connection to the City’s existing distribution system, and a water line to Nile Garden Elementary School; and WHEREAS, on September 20, 2022, City Council approved a professional service agreement with Wood Rodgers, Inc. (Wood Rodgers) for the preparation of Plans, Specifications, and Estimates (PS&E) for the Project for a total of $505,447; and WHEREAS, on June 20, 2023, City Council awarded construction of Phase 1 Drilling to Nor-Cal Pumping Services for $927,853; and WHEREAS, on December 5, 2023, City Council approved Amendment No. 1 in the amount of $10,500 to Wood Rodgers’ professional service agreement; and WHEREAS, on March 5, 2024, City Council awarded construction of Phase 2 Equipping to T&S Construction for $4,925,000; and WHEREAS, during the drilling of the well, unsuitable soil conditions were encountered that required additional data gathering, reevaluation of design assumptions and design adjustments. As construction continues additional coordination is needed with the construction contractor, PG&E, San Joaquin County, and MUSD; and WHEREAS, amendment No. 2 would include additional budget and time needed to complete the Project; and WHEREAS, sufficient funds existing in the SWRCB Grant 3910005-001C. Funding for Phase 1 Drilling is $920,328, Phase 2 Equipping $4,775,000, and Design Services & Contingency $2,679,560 for a total not to exceed grant of $8,374,888; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establishes the factual basis for the City Council’s adoption of this Resolution.
The City Council hereby approves Amendment No. 2 to the professional services agreement with Wood Rodgers, Incorporated, for the Nile Garden Well 30 Water Supply Project extending the Time of Performance to December 31, 2025.
The City Council hereby approves increasing the maximum not to exceed compensation by $200,000 for a total not to exceed to $715,947.
The City Council hereby authorizes the City Manager or designee to apply for permits, apply for State and Federal grants, solicit project funding support, complete and execute all associated documents, and take all appropriate actions necessary to carry out the purpose and intent of the resolution.
This Resolution shall take effect immediately upon adoption.
