RESOLUTION R2024-XX
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, ACCEPTING ALL IMPROVEMENTS FOR THE CORWIN DRIVE & SUESS COURT WATER & SEWER LINE INSTALLATION PROJECT CIP NO. 23008 AS COMPLETE, AUTHORIZING THE CITY CLERK TO FILE THE NOTICE OF COMPLETION, AND AUTHORIZING THE CITY MANAGER OR DESIGNEE TO COMPLETE AND EXECUTE ALL ASSOCIATED DOCUMENTS, AND TAKE ALL APPROPRIATE ACTIONS NECESSARY TO CARRY OUT THE PURPOSE AND INTENT OF THE RESOLUTION WHEREAS, on July 18, 2023, City Council awarded the construction contract for the Corwin Drive & Suess Court Water & Sewer Line Installation Project CIP 23008 (Project) to D.A. Wood Construction, Inc. (Contractor) for an amount of $853,097 and approved a construction contingency of $85,310 for a total project cost of $938,407; and WHEREAS, the Project was constructed in general conformance with the conformed plans and specifications; and WHEREAS, the final Project included a total of 4 contract change orders totaling $75,712.87, which is within the approved construction contingency. The change orders were needed for additional costs associated with changes encountered in the field including:
- Field locating sewer line connection points in coordination with property owners; - Change in waterline pipe material to a ductile iron pipe at existing storm drain crossings; - Placement of microsurfacing surface treatment instead of cape seal; - Replacement of missing survey monument cover;
- Restriping the stop legend marking and limit line for a better final product; and WHEREAS, the final project construction cost is $928,809.87, the Contractor has submitted the signed final payment certification; and WHEREAS, there is a 5% retention totaling approximately $46,440.49 that will be released to the Contractor no sooner that 45 days and no later than 60 days after filing of the notice of completion; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council hereby accepts all improvements for the Corwin Drive & Suess Court Water & Sewer Line Installation Project CIP No. 23008 as complete.
The City Council hereby authorizes the City Clerk to file the Notice of Completion for the Corwin Drive & Suess Court Water & Sewer Line Installation Project CIP No. 23008.
The City Council hereby authorizes the City Manager or designee to complete and execute all associated documents, and take all appropriate actions necessary to carry out the purpose and intent of the resolution.
This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 3rd day of September, 2024, by the following vote:
