RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, approving Plans and Specifications for the facilities driveway Project cip 24029, authorizing a Call for Bids, and authorizing the City Manager or designee to take all appropriate actions necessary to carry out the purpose and intent of the RESOLUTION (EXCLUDED FROM NEPA PER SLFRF 2022 OVERVIEW OF THE FINAL RULE AND EXEMPT FROM CEQA PURSUANT TO 14 CAL. CODE REGS. § 15301(C)) WHEREAS, Plans, Specifications, and Estimate have been completed for the Facilities Driveway Project CIP 24029 (Project). This Project includes the placement of placement of concrete driveway, sidewalk, concrete parking yard, storm drain system, and trench paving. The Project is located at 740 W Center Street; and WHEREAS, The Project will primarily improve the Facilities Maintenance onsite stormwater management and improvements to the driveway and parking yard are ancillary to the improvements to onsite stormwater management; and WHEREAS, the project is partially funded by the American Rescue Plan Act which is under oversight of the Treasury Department. Per the March 29, 2024 Coronavirus State & Local Fiscal Recovery Funds (SLFRF) Frequently Asked Questions 6.3, NEPA requirements do not apply to Treasury’s administration of SLFRF funds, under eligible use categories of: water, sewer, and broadband infrastructure; and WHEREAS, the SLFRF 2022 Overview of the Final Rule, defines the category of water, sewer, and broadband infrastructure to include “stormwater management”; and WHEREAS, staff has reviewed and determined that the Project is Categorically Exempt under the California Environmental Quality Act (CEQA) based on Article 19 Section 15301(c), Class 1 “Existing Facilities”; and WHEREAS, a Notice of Exemption will be filed with the San Joaquin County Clerk/Recorder and the State Clearinghouse for the Project pursuant to 14 Cal. Code Regs. § 15094. Plans, Specifications, and Estimates (PS&E) have been completed for the Project and are available for review in the Engineering Department; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council hereby approves Plans and Specifications for the Facilities Driveway Project CIP 24029 and authorizes a Call for Bids.
The City Council hereby determines that NEPA requirements do not apply to the Project per the SLFRF 2022 Overview of the Final Rule.
The City Council hereby finds the Project exempt from CEQA pursuant to Article 19 Section 15301(c), Class 1 “Existing Facilities”; approves the California Environmental Quality Act Notice of Exemption Determination for the Project.
The City Council hereby authorizes the City Manager or designee to apply for permits, apply for State and Federal grants, solicit project-funding support, complete and execute all associated documents, and take all appropriate actions necessary to carry out the purpose and intent of this resolution.
This Resolution shall take effect immediately upon its adoption.
