RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA APPROVING AMENDMENT NO. 2 TO PROFESSIONAL SERVICES AGREEMENT WITH WSP USA, INCORPORATED FOR THE SR120 / MCKINLEY AVENUE INTERCHANGE PROJECT; EXTENDING THE TIME OF PERFORMANCE TO JUNE 30, 2025; INCREASING THE MAXIMUM NOT TO EXCEED COMPENSATION BY $194,665 FOR A TOTAL NOT TO EXCEED OF $3,146,285; AND AUTHORIZE THE CITY MANAGER OR DESIGNEE TO TAKE ALL APPROPRIATE ACTIONS NECESSARY TO CARRY OUT THE PURPOSE AND INTENT OF THE RESOLUTION WHEREAS, the City of Manteca (City), in cooperation with the California Department of Transportation (Caltrans), and the San Joaquin Council of Governments (SJCOG), partnered to construct a new State Route 120 / McKinley Ave Interchange project (Project); and WHEREAS, on June 7, 2022, the City Council awarded the Professional Services Agreement with WSP USA, Inc. (WSP) for $2,364,537 to provide Construction Management and Inspection Services (CM&IS) for the construction of SR120/McKinley Avenue Interchange project (CIP 11034); and WHEREAS, on May 16, 2023, the City Council approved Amendment No. 1 with WSP for $587,083 to the CM&IS agreement due to construction delays associated with wet weather; and WHEREAS, during construction, additional water and sewer utilities were added to the project to support the future growth of the area. The additional construction work extended the planned project end date, construction management and inspection services schedule. The City is processing the project’s closing documents with Caltrans and the contractor to finalize the administrative tasks of the project; and WHEREAS, amendment No. 2 would include additional contract budget and time needed to complete the Project administration; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establishes the factual basis for the City Council’s adoption of this Resolution.
The City Council hereby approves Amendment No. 2 to the professional services agreement with WSP USA, Incorporated, for the State Route (SR) 120 / McKinley Ave Interchange Project increasing the maximum not-to-exceed compensation by $194,665 (Account: 440.00.00.900-8150.41 and 590.00.00.900-8150.14) for a total not-to-exceed to $3,146,285.
The City Council hereby authorizes the City Manager or designee to apply for permits, apply for State and Federal grants, solicit project funding support, complete and execute all associated documents, and take all appropriate actions necessary to carry out the purpose and intent of the resolution.
This Resolution shall take effect immediately upon adoption.
