RESOLUTION R2024-XXX
RESOLUTION ACCEPTING ALL IMPROVEMENTS FOR THE 2023 ANNUAL PAVEMENT MAINTENANCE PROJECT CIP 23036 AS COMPLETE, AUTHORIZING THE CITY CLERK TO FILE THE NOTICE OF COMPLETION, AND AUTHORIZING THE CITY MANAGER OR DESIGNEE TO COMPLETE AND EXECUTE ALL ASSOCIATED DOCUMENTS, AND TAKE ALL APPROPRIATE ACTIONS NECESSARY TO CARRY OUT THE PURPOSE AND INTENT OF THE RESOLUTION.
WHEREAS, on July 18, 2023, City Council awarded the construction contract C2023-196 for the 2023 Annual Pavement Maintenance Project CIP 23036 (Project) to DRYCO Construction, Inc. (Contractor) for an amount of $1,183,292.80 and approved a construction contingency of $266,241 for a total project cost of $1,449,533.80; and WHEREAS, the Project was constructed in general conformance with the conformed plans and specifications; and WHEREAS, the final Project had no change orders and final project construction cost is $1,075,366.42, the Contractor has submitted the signed final payment certification (Attachment 3); and WHEREAS, there is a 5% retention totaling approximately $53,768.32 that will be released to the Contractor no sooner than 45 days and no later than 60 days after filing of the notice of completion; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council of the City of Manteca does hereby accept the Notice of Completion for the 2023 Annual Pavement Maintenance Project CIP 23036 and hereby instructs the City Clerk for the City of Manteca, to attend to the proper recordation of same.
The City Council authorizes the City Manager or designee to complete and execute all associated documents and take all appropriate actions necessary to carry out the purpose and intent of this resolution.
This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 19th day of November, 2024 by the following vote:
