RESOLUTION R2024-XX
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE A MEMORANDUM OF UNDERSTANDING WITH SAN JOAQUIN COUNTY ENVIRONMENTAL HEALTH REGARDING THE INSPECTION AND COMPLIANCE WITH THE CITY’S EDIBLE FOOD RECOVERY PROGRAM.
WHEREAS, the City has established an edible food recovery program, within Chapter 13.02 of the Manteca Municipal Code, as required by the California Code of Regulations, Title 14, Division 7, Chapter 12 (the "SB 1383 Regulations") (the "Edible Food Recovery Program"); and WHEREAS, the County, through its Environmental Health Department, has offered to conduct on-site inspections and records review pursuant to the City's Edible Food Recovery Program within the City on behalf of the City; and WHEREAS, 14 CCR Section 18981.2 authorizes the City to designate a public entity, such as the County, to fulfill some of its regulatory responsibilities for the Edible Food Recovery Program through an Memorandum of Understanding (MOU); and WHEREAS, Section 13.02.205 of the Manteca Municipal Code provides that the City or its designee may inspect all premises within the City to determine compliance with and enforce the relevant provisions of Chapter 13.02.205 of the Manteca Municipal Code.
WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
City Council hereby approves, and authorizes the City Manager to execute, the MOU with San Joaquin County Environmental Health, and any and all associated documents and/or amendments.
This Resolution shall take effect immediately upon adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 19th day of November, 2024, by the following vote:
