RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, APPROVING AMENDMENT NO. 4 TO THE PROFESSIONAL SERVICES AGREEMENT C2023-153 WITH DEWBERRY ENGINEERS INC. FOR A TOTAL NOT-TO-EXCEED AMOUNT OF $384,818.80 TO COVER ADDITIONAL COSTS ASSOCIATED WITH CONSTRUCTION MANAGEMENT AND INSPECTION SERVICES AND AUTHORIZE THE CITY MANAGER OR DESIGNEE TO EXECUTE ALL ASSOCIATED DOCUMENTS AND TAKE ALL APPROPRIATE ACTIONS NECESSARY TO CARRY OUT THE PURPOSE AND INTENT OF THE RESOLUTION WHEREAS, the Highway Safety Improvement Program (HSIP) is a federal program that funds transportation-related safety projects including traffic sign improvements for local roadways and is administered by the California Department of Transportation (CalTrans). The City of Manteca (“City”) received an HSIP grant for the Retroreflective Traffic Sign Project CIP No. 16027 (the “Project”); and WHEREAS, on November 21, 2023, City Council awarded a construction contract for the Project to Chrisp Company for an amount of $1,489,745.83 and executed the professional services agreement C2023-1553 with Dewberry Engineering Inc. (“Dewberry”) for construction management services in amount of $282,800.35, and a project professional services contingency of $28,280.65, for a total not to exceed construction management service budget of $311,081; and WHEREAS, CalTrans awarded $1,925,000 in HSIP grant for Project construction and $280,000 in HSIP grant for Project construction management services. Since the Project construction contract was less than the construction grant amount and the HSIP grant does not require a local match, City staff worked with CalTrans, to issue construction change orders to upgrade additional existing outdated traffic signs that were not in compliance with current California Manual for Uniform Traffic Control Devices. This resulted in the need for increased construction management services from Dewberry thereby the execution of Amendment No. 1, Amendment No. 2, and Amendment No. 3, providing incremental increase of compensation and extending the term of the Agreement; and WHEREAS, on November 19, 2024 City accepted the Project as complete. The final Project construction cost was $1,820,181.20, which is $104,818.80 less than the $1,925,000 grant allocated for construction. City staff requested that the Project construction cost savings be transferred to Project construction management services; and WHEREAS, on January 11, 2025, Caltrans approved the City’s request and modified the HSIP Grant (HSIPL-5242 (033) to increase the construction engineering grant budget to $384,818.80. This allows City to fully utilize the remaining HSIP grant funds and optimize improvements to the City's traffic signage infrastructure; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council hereby approves Amendment No. 4 to the professional services agreement C2023-153 with Dewberry Engineers Inc. for a total not-to-exceed amount of $384,818.80 to cover additional costs associated with construction management and inspection services.
The City Council hereby authorizes the City Manager or designee to execute all associated documents and take all appropriate actions necessary to carry out the purpose and intent of the resolution.
This Resolution shall take effect immediately upon its adoption.
