RESOLUTION APPROVING AMENDMENT NO. 2 TO THE IMPROVEMENT AGREEMENT FOR 320 AIRPORT WAY SUBDIVISION, TRACT 4165, MODIFYING SCHEDULE B, SECTION IV, ADDING AIRPORT WAY SANITARY SEWER FORCE MAIN REIMBURSEMENT IN THE AMOUNT OF $150,250.90 TO BE PAID FROM THE UNDESIGNATED RESERVE SEWER OPERATIONS AND MAINTENANCE FUND (FUND 640); AND AUTHORIZING THE CITY MANAGER OR DESIGNEE TO SIGN AND TAKE ALL NECESSARY STEPS TO EFFECTUATE THIS AMENDMENT NO. 2 WHEREAS, on December 3, 2024, the City of Manteca and 320 Airport Way, LLC, entered into an Improvement Agreement (Agreement) for the 320 Airport Way Subdivision, Tract 4165 (C2025-08) with the Estimated Total Cost of Improvements of $9,691,400.65; and WHEREAS, the 320 Airport Way Subdivision improvement plans included widening N. Airport Way, constructing a new segment of Center Street, and installing frontage improvements, and were reflected in Schedule B of the Improvement Agreement; and WHEREAS, during construction of the frontage improvements, repairs were needed to be made to a segment of the existing sanitary sewer force main in N. Airport Way; and WHEREAS, the City of Manteca and 320 Airport Way, LLC, now desire to amend the Improvement Agreement for the 320 Airport Way Subdivision, Tract 4165 (C2025-08) to include the reimbursement costs of these repairs to Schedule B, Section IV; and WHEREAS, the City Council has considered all information related to this matter as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct and establish the factual basis for the City Council’s adoption of this Resolution.
2. The City Council hereby approves Amendment No. 2 to the Improvement Agreement for 320 Airport Way, Tract 4165 (C2025-08), adding Schedule B, Section IV, Airport Way Sanitary Sewer Force Main Reimbursement in the amount of $150,250.90 to be paid from the Undesignated Reserve Sewer Operations and Maintenance Fund (Fund 640).
3. The City Council hereby authorizes the City Manager or designee to sign and take all necessary steps to effectuate this Amendment No. 2.
4. This Resolution shall take effect immediately upon its adoption.
