RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, Approving the improvement agreement for the woodward avenue sewer trunk main and authorizing the city manager OR DESIGNEE to sign and takE all necessary steps to effectuate the agreement WHEREAS, Yosemite Square Subdivision was conditioned to construct the Woodward Avenue Sewer Trunk Main (Project) by the City Council on March 21, 2023; and WHEREAS, in accordance with the City of Manteca Municipal Code, Title 16, Lennar Homes of California, LLC, developer of the subdivision and Project, has presented to the City Council of the City of Manteca the Improvement Agreement for the Project to construct the final section of the sanitary sewer & storm drain trunk main as part of the Woodward Avenue Sewer & Storm Drain Project originally started in 2013; and WHEREAS, due to the nature of the sanitary sewer main construction, certain other improvements are necessary for the restoration and improvement to Woodward Avenue, including: the completion of the sewer trunk main, the storm drain trunk main, storm drainage improvements, relocation of existing water main, installation of sewer lines for future connections, installation of new curb, gutter & sidewalk at various locations, pavement widening at various locations, restoration and repair of existing pavement, and signing & striping of Woodward Avenue; and WHEREAS, in accordance with the Manteca Municipal Code, Title 16, Developer has posted the required surety bonds in the amounts specified in the Reference Data section of the Improvement Agreement; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council does hereby approve the Improvement Agreement for the Woodward Avenue Sewer Trunk Main.
The City Council does hereby authorize the City Manager or designee to sign and take all necessary steps to effectuate the agreement on behalf of the City of Manteca and authorizes the City Clerk to attest thereto and impress the official seal upon the same.
This Resolution shall take effect immediately upon adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 21st day of April, 2026, by the following vote:
