RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, APPROVING A PERMIT AGREEMENT WITH RECLAMATION DISTRICT 17 AND MEMORANDUM OF UNDERSTANDING WITH OAKWOOD LAKES WATER DISTRICT FOR THE ZONE 36/39 STORM DRAIN IMPROVEMENTS PHASE I OUTFALL PROJECT CIP NO. 20004 (LOCATED BETWEEN THE WOODWARD AVENUE AND APPLICELLA COURT INTERSECTION AND EXTENDING WEST APPROXIMATELY 3000’) AND AUTHORIZING THE CITY MANAGER OR DESIGNEE TO TAKE ALL APPROPRIATE ACTIONS NECESSARY TO CARRY OUT THE PURPOSE AND INTENT OF THE RESOLUTION WHEREAS, The City of Manteca (City) identified the need to provide storm water drainage for the portion of the City south of State Route 120; and WHEREAS, the Zone 36/39 Storm Drain Improvements Phase 1 Outfall Project CIP No. 20004 (Project) is the first of two phases designed to meet this need and will construct a new outfall on the San Joaquin River as well as a new conveyance line from just west of the Woodward Avenue and Aplicella Court intersection to the outfall location; and WHEREAS, on May 12, 2026, the City Council awarded the construction contract for the Project to Mozingo Construction, Incorporated; and WHEREAS, portions of the Project will be constructed on property owned by either Reclamation District 17 (RD17) or Oakwood Lakes Water District (OLWD) and as such the City has been coordinating with both agencies through the Project’s design for the necessary construction easements; and WHEREAS, the Permit Agreement with RD17 and the Memorandum of Understanding with OLWD provide the City with the respective necessary authorizations to construct the Project; and WHEREAS, the Project necessitates exchanges between the City, RD17, and OLWD in the form of easements, land, construction, and any net payment due, and all three agencies concur to address these exchanges in a separate future agreement; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council hereby approves the Permit Agreement with Reclamation District 17 for the Zone 36/39 Storm Drain Improvements Phase I Outfall Project CIP No. 20004.
The City Council hereby approves the Memorandum of Understanding with Oakwood Lakes Water District for the Zone 36/39 Storm Drain Improvements Phase I Outfall Project CIP No. 20004.
The City Council hereby authorizes the City Manager or designee to apply for permits, apply for State and Federal grants, solicit project-funding support, complete and execute all associated documents, and take all appropriate actions necessary to carry out the purpose and intent of this resolution.
This Resolution shall take effect immediately upon its adoption.
