RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, APPROVING A SECOND AMENDMENT TO PROFESSIONAL SERVICES AGREEMENT NO. C2025-150 WITH HARRIS & ASSOCIATES, INC. FOR FISCAL IMPACT ANALYSIS PEER REVIEW SERVICES, INCREASING THE TOTAL NOT-TO-EXCEED CONTRACT AMOUNT TO $100,000 WHEREAS, the City of Manteca (“City”) entered into Professional Services Agreement No. C2025-150 (“Agreement”) with Harris & Associates, Inc. (“Harris”) on August 25, 2025, for the provision of Fiscal Impact Analysis (“FIA”) Peer Review services; and WHEREAS, the Agreement provides for Harris to perform independent peer review of Fiscal Impact Analyses submitted to the City in connection with development and annexation applications, including review of methodologies, assumptions, projected revenues and expenditures, and consistency with local fiscal conditions and industry practices; and WHEREAS, the original Agreement established a maximum compensation amount of Fifty Thousand Eight Hundred Sixty-Four Dollars ($50,864); and WHEREAS, the City and Harris subsequently entered into the First Amendment to the Agreement, which amended the scope of services and extended the term of the Agreement through June 30, 2027; and WHEREAS, the City continues to require professional FIA peer review services to assist in evaluating the fiscal impacts of proposed development and to ensure that anticipated revenues, expenditures, and underlying assumptions are appropriately identified and evaluated consistent with City requirements; and WHEREAS, Harris submitted an amendment proposal dated May 22, 2026, to continue providing FIA Peer Review services to the City, with a proposed revised total agreement authorization of One Hundred Thousand Dollars ($100,000); and WHEREAS, Harris’ updated scope provides for project management, coordination, FIA peer review, preparation of written comments and recommendations, and meetings with City staff and applicants; and WHEREAS, the City desires to amend the Agreement to provide additional contract capacity for continued FIA Peer Review services during the remaining term of the Agreement; and WHEREAS, increasing the Agreement by Forty-Nine Thousand One Hundred Thirty-Six Dollars ($49,136) will increase the total not-to-exceed compensation from $50,864 to $100,000; and WHEREAS, Section 5 of the Agreement authorizes amendments, changes, or modifications to the Agreement by mutual written agreement of the parties.
WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council hereby approves an amendment to Professional Services Agreement No. C2025-150 with Harris & Associates, Inc. for Fiscal Impact Analysis Peer Review services, increasing the maximum compensation by $49,136, from $50,864 to a total not-to-exceed amount of $100,000.
The City Manager, or designee, is hereby authorized to execute the amendment and any documents necessary to implement the amendment on behalf of the City of Manteca, subject to approval as to form by the City Attorney.
Except as expressly modified by the amendment, all other terms and conditions of Professional Services Agreement No. C2025-150, as previously amended, shall remain in full force and effect.
This Resolution shall take effect immediately upon adoption.
