RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MANTECA, STATE OF CALIFORNIA, APPROVING THE IMPROVEMENT AGREEMENT FOR THE TRAILS OF MANTECA – ZONE 36/39 STORM DRAIN AND SEWER TRUNK PIPELINE; AUTHORIZING THE CITY MANAGER OR DESIGNEE TO SIGN AND TAKE ALL NECESSARY STEPS TO EFFECTUATE THE AGREEMENT WHEREAS, the Zone 36/39 Storm Drain pipeline is designed to accommodate conveyance of stormwater flows south of State Route 120 to a new surface water discharge into the San Joaquin River at the west end of the City of Manteca (City) limit; and WHEREAS, the City Council approved the construction of the first phase of the outfall project on May 12, 2026, with the second phase consisting of installation of the storm drain pipeline from Woodward Ave/Bella Lago Way intersection to the Woodward Ave/Aplicella Ct. intersection and the third phase comprising construction of a new pump station; and WHEREAS, the second phase of the Zone 36/39 storm drain pipeline to be installed as part of this improvement agreement serves as a vital portion of the system that will connect the existing installed storm drain pipeline from Bella Lago Way to the future pump station; and WHEREAS, the second phase of work is required to be installed by the Trails of Manteca (Trails) development and will be routed through the Trails subdivision along the future Bella Lago Way, Cascade Drive, and Everest Drive to the Woodward Ave/Aplicella Ct. intersection; and WHEREAS, it is prudent and most efficient that concurrent with the storm drain pipeline work the Trails developer also extend, along the same alignment, the City’s planned 10” sewer trunk line; and WHEREAS, in accordance with the City of Manteca Municipal Code, Title 16, Manteca Trails, LLC (Developer), developer of the site has presented to the City Council of the City of Manteca the Improvement Agreement for the Trails of Manteca – Zone 36/39 Storm Drain and Sewer Trunk Pipeline; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council does hereby approve the Improvement Agreement for the Trails of Manteca – Zone 36/39 Storm Drain and Sewer Trunk Pipeline.
The City Council does hereby authorize the City Manager or designee to sign and take all necessary steps to effectuate the agreement on behalf of the City of Manteca and authorizes the City Clerk to attest thereto and impress the official seal upon the same.
This Resolution shall take effect immediately upon adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 15th day of September, 2026, by the following vote:
