1st AMENDMENT OF CONTRACT
BY AND BETWEEN CITY OF MANTECA
AND A-1 Remediation
THIS 1st AMENDMENT (“Amendment”) to the August 31, 2026 Agreement by and between the City of Manteca and A-1 Remediation ("Agreement") is made and entered into this {{esl:Signer4:textfield:size(75,20),offset(0,-12)}} day of {{esl:Signer4:textfield:size(75,20),offset(0,-12)}} , {{esl:Signer4:textfield:size(75,20),offset(0,-12)}} by and between the CITY OF MANTECA, a municipal corporation of the State of California (hereinafter referred to as "CITY"), and A-1 Remediation.
RECITALS:
A. WHEREAS, CITY and A-1 Remediation entered into the Agreement on or around August 31, 2026, for the provision of Structural repairs at 555 Industrial Park Drive; and
B. WHEREAS, the CITY and A-1 Remediation desire to include structural repairs for an additional amount of $83,414.00 under the Agreement.
C. WHEREAS, Section Section 5. Amendments, Changes or Modifications of the Agreement allows the Parties to mutually agree to amend the Agreement in writing.
NOW, THEREFORE, in consideration of their mutual covenants, the parties hereto agree as follows:
AGREEMENT
1. INCORPORATION OF RECITALS. The recitals set forth above are hereby incorporated into this Amendment as if set forth herein in full.
2. AMENDMENT.
Section 1. Scope of Services., to the Agreement is hereby amended to read as follows: Exhibit A. Scope of Work to the Agreement is amended to include Exhibit A. to this Amendment Agreement, attached hereto and incorporated herein by reference as Scope of Work.
Section 3. Compensation, to the Agreement is hereby amended to read as follows:
Compensation to be paid to Consultant shall be in accordance with the Payment Schedule set forth in Exhibit A., which is incorporated herein by reference. In addition to the Compensation for the Agreement, compensation for Amendment No. 1, shall in no event exceed $83,414.00 (Eighty Three Thousand Four Hundred Fourteen Dollars and Zero Cents) without additional authorization from the City. In no event shall total compensation for work performed pursuant to this Agreement and Amednment No. 1 exceed $235,130.00 (Two Hundred Thirty Five Thousand One Hundred Thirty Dollars and Zero Cents) without additional authorization from the City. 2353958.1 13645.001 Page 2 of 3
3. OTHER TERMS. Except as expressly amended herein, the Agreement remains in full force and effect. Nothing in this Amendment shall be deemed to waive or modify any of the other provisions of the Agreement. SOFT DEMOLITION PROPOSAL
A-1 Remediation Service is pleased to provide you with this proposal for the above-mentioned project. This estimate is for abatement only. It does not include any repair work.
SCOPE OF WORK
Wall Framing
1. Remove all wall framing throughout structure interior.
2. Save fire sprinklers
3. Remove and dispose of door frames
Time Frame
4. Project is estimated to take 15-20 days. An additional 1-2 days should be added to time frame if a clearance is required.
Exclusions
5. Owner to provide electric and water.
6. Repair or replacement of impacted structural, architectural, mechanical or electrical item.
7. Damage resulting from abatement procedures such as, but not limited to: tape damages to paint, paneling or wallpaper; moisture damage to walls or flooring.
Payment
8. Payment is required within 30 days of project completion.
9. A lien will be placed on the property after 30 days and the associated fees will be added to the bill.
