RESOLUTION APPROVING AMENDMENT NO. 1 TO THE IMPROVEMENT AGREEMENT FOR MACHADO RANCH UNIT NO. 2, MODIFYING SCHEDULE B, MODIFYING TRANSPORTATION SYSTEM PUBLIC FACILITIES IMPLEMENTATION PLAN (PFIP) REIMBURSEMENT, INCREASING THE TRANSPORTATION FACILITIES PFIP REIMBURSEMENT FROM $3,703,132.84 TO $4,276,064.70; AND AUTHORIZING THE CITY MANAGER OR DESIGNEE TO SIGN AND TAKE ALL NECESSARY STEPS TO EFFECTUATE THE AMENDMENT WHEREAS, on February 18, 2025, the City of Manteca and Meritage Homes of California, Inc. (Developer), entered into an Improvement Agreement for Machado Ranch Unit No. 2 Offsite and In-tract Improvements (C2025-37) with the Estimated Total Cost of Improvements of $20,492,348.10; and WHEREAS, the Improvement Agreement reimbursable amount to the Developer for the Transportation Facilities System PFIP is $3,012,297.04 plus an additional $690,835.80 for dry utility relocations including transmission poles on S. Airport Way and Woodward Avenue; and WHEREAS, the relocation work is now complete, however the total cost for these relocations is $1,263,767.66, resulting in an additional $572,931.86 in reimbursement to the Developer for a PFIP Transportation Facilities System reimbursable total of $4,276,064.70; and WHEREAS, the City Council has considered all information related to this matter as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Manteca, as follows:
1. The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct and establish the factual basis for the City Council’s adoption of this Resolution.
2. The City Council approves Amendment No. 1 to the Improvement Agreement for Machado Ranch Unit No. 2, modifying SCHEDULE B, modifying Transportation System Public Facilities Implementation Plan (PFIP) Reimbursement, increasing the Transportation Facilities PFIP Reimbursement from $3,703,132.84 to $4,276,064.70.
3. The City Council authorizes the City Manager or designee to sign and take all necessary steps to effectuate the amendment.
4. This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Manteca at a public meeting of said City Council held on the 20th day of October 2026, by the following vote:
