AGENDA ITEM
TITLE: Mayor's Report re Disposition of Miscellaneous Weapons Owned by City of Maricopa via Former Maricopa Police Department
PROPOSED BY: Eric G. Ziegler
MEETING DATE: January 9, 2024
RECOMMENDATION
Provide whatever additional direction Council deems appropriate to Mayor re Disposition of Miscellaneous Weapons Owned by City of Maricopa via Former Maricopa Police Department
BACKGROUND
Note: This issue of Disposition of Miscellaneous Weapons Owned by City of Maricopa via Former Maricopa Police Department last appeared on the Council Agenda for the regularly scheduled meeting of Tuesday, November 14, 2023 It that time, Council directed that the weapons in question be consigned to Valley Guns of Bakersfield for sale with ar 80/20 split of proceeds, 80 percent going to the city. Council also authorized Mayor Morse to undertake these transactions on behalf of the city. Mayor Morse now wishes to report the result of his efforts to the Council and to seek additional direction as may be required.
This item appeared on the agenda of the regularly scheduled meeting of Tuesday, October 10, 2023 (copy attached). At that time, Council declined a staff recommendation to transfer ownership of weapons inventoried in Taft Police Department General Information Case Report dated 04/10/2012, incident number 120410004 to the City of Taft Police Department as a donation of surplus property from one public agency to another.
Council instead expressed an interest in legally selling surplus weapons "on consignment" through a licensed gun dealer.
Staff has visited and spoken with five licensed gun dealers, two of whom are located in Taft.
1. Valley Guns, 2728 Chester Avenue, Bakersfield
Valley Guns is a long-established and highly reputable gun dealer. They accept guns on consignment with an 80/20 split of proceeds, 80% going to the seller.
2. Turner's Outdoorsman, 2523 Mohawk, Bakersfield
Turners is a retail chain stocking equipment, apparel and accessories for hunting, fishing and sport shooting. They accept guns on consignment with a 75/25 split of proceeds, 75% going to the seller.
3. Dirty Bird Guns and Ammo, 2420 Mohawk, Ste 700, Bakersfield Dirty Bird is a comparatively new vendor. They cannot accept guns on consignment although they stated that they may be interested in buying the weapons outright. They would ultimately re-sell them as store inventory.
4. Black Gold Guns and Ammo, 510 Center Street, Taft
Black Gold is an established dealer in the city of Taft. The owner stated that he does not accept guns on consignment.
5. Westside Arms, 518 Kern Street, Taft
Westside Arms is an established gun dealer in Taft. Its owner is well known in the community. It's not clear whether Westside Arms is the successor to Ten Percent Firearms which has been in Taft for many years or is simply a newer business with a common ownership. The owner stated that he cannot take guns on consignment because he doesn't have a Second Hand Firearms Dealer license.
In talking with Valley Guns and Turner's, there is apparently a consignment agreement (copies were not available from either source) in which the seller places the weapons for sale with the dealer at a defined and mutually agreed upon price. Once the guns are actually consigned to the dealer, the weapons are placed in "quarantine" which means that they can't be sold for 30 days after consignment to the dealer. After the "quarantine" period has expired, the weapons can be sold to any qualified buyer at the agreed upon price at the time of consignment. After the sale is complete and the weapon legally transferred, the seller receives the agreed upon price less the dealer's commission, in this case either 20% (Valley Guns) or 25% (Turner's).
One other point: Both Valley Guns and Turner's have said that the AR-15 cannot legally be brought into the store or sold unless it is "California compliant." Both have also stated that because the weapon was bought for and used in police service, it is most likely NOT "California compliant." However, Valley Guns advises that non-compliant weapons can be modified to achieve "California compliance" status, though the cost of doing so was undiscussed and is therefore unknown.
If Council wishes to sell these weapons as surplus property, it is appropriate to consider a motion to declare the following weapons designated in Exhibit A hereto and formerly assigned to the now disbanded Maricopa Police Department as surplus property and to authorize sale of the said weapons through consignment to Valley Guns, a legally licensed gun dealer located, at 2728 Chester Avenue, Bakersfield California andto authorize Mayor to execute all documents needed to execute this process on behalf of the City of Maricopa.

RECOMMENDATION
Motion to Approve License Agreement Between City of Maricopa and VFW Post 11012 for Use of Gusher Hall as a Food Bank Distribution Point and to Authorize Mayor Pro-Tem and City Clerk to Execute the Agreement on Behalf of the City.
BACKGROUND
Note: This item is on the Agenda as follow-up from the regularly scheduled meeting of Tuesday, December 12, 2023. Because one Council Member (Owens) was absent from that meeting and because two Council Members (Morse and Crump) are members of the VFW Post seeking approval of this item (the City Attorney opined that her two VFW members could not vote on the item Council had fewer than three members eligible to vote on the item at the December 12 meeting. Thus, the item is on this agenda for whatever action Council deems appropriate.
Attached hereto is correspondence from VFW Post 11012 seeking to use Gusher Hall for distributing food for indigent and needy people in the community. The correspondence is self-explanatory, Staff understands that the VFW is becoming partner of the CAPK (Community Action Partnership Kern) Food Bank program. Attached is a flier summarizing the Food Bank Program and other CAPK services.
The program being proposed by the VFW is essentially the same program that distributed food to the community from Gusher Hall for a number of years before the program manager for Maricopa retired. With no successor available to run the program, Maricopa was left without the service forcing Maricopans to go to Taft or elsewhere for food distribution.
The VFW has submitted proof of its tax exempt status as well as proof of insurance with the per the terms, conditions and exclusions city as additional named insured Given Maricopa's status as an underserved community and given the economic circumstance of the community and its residents, staff believes that this program would be highly beneficial to the community.
Accordingly, staff recommends that Council approved the VFW's request for the use of Gusher Hall as a food distribution site with the clarification of three issues: 1) Additional Named insured coverage; 2) primary defense coverage re claims made arising from VFW use of the facility for stated purpose; 3) clarification of terms, conditions and exclusion.
Assuming the above issues are resolved, staff recommends that Council favorably consider adopting a motion to Approve License Agreement Between City of Maricopa and VFW Post 11012 for Use of Gusher Hall as a Food Bank Distribution Point and Authorize Mayor Pro-Tem and City Clerk to Execute the Agreement on Behalf of the City.

To: Whom It May Concern
We, the Maricopa VFW Post 11012, do humbly request the use of Gusher Hall, specifically the parking lot, at predetermined times as agreed upon, for the purpose of distributing food for the indigent and/or needy people of our community. We are a 501(c)(19) entity, and fully insured for Gusher Hall and its adjacent parking lot.
We currently plan on providing this service once per month, with use of the parking lot for 4-6 hours. We would not require access to the Gusher Hall building for these services but would need access to provide proper bathroom facilities for our onsite volunteers.
We would like to get this started as quickly as possible. Considering the holidays for 2023, we would like to plan a tentative date prior to Christmas Day for December 2023. We then look to build this program up through 2024. We would greatly appreciate the use of your facilities to get this underway.
Please feel free to contact our Commander, Cory Morse, at (661) 437-5760, or me, Quartermaster Krista Knox, at (661) 934-2126. You can also reach us by email at [email protected].

BACKGROUND
In October, 2016, the city contracted with AM Engineering of Fresno to prepare and submit a grant application for a $500,000 planning grant from the State Water Resources Board to pursue replacement of the city's existing sanitary sewer system and to extend sanitary sewers to areas of the city not currently connected to the sanitary sewer system..
Four years after the Planning Grant was awarded and based on the preparatory work done under the planning grant, the city applied for SWRCB funding for the project contemplated in the Planning Grant and was awarded an SWRCB "forgivable loan" Funding Agreement in the amount Of $7,378, 169. The Funding Agreement was approved by the City Council and was signed by the city on June 1, 2021 and by SWRCB on September 1, 2021.
In October, 2021, the city released a Request for Qualifications (RFQ) seeking Engineering Design and Construction Management Services for the proposed project. That process resulted in award of contract for the sought after services to AM Consulting Engineers by the City Council in March, 2022.
Staff has now received the following Plans and Specifications for this project,
