THE CITY COUNCIL OF THE CITY OF MARICOPA FINDING THERE ARE NO UNMET TRANSIT NEEDS WHICH CAN REASONABLY BE MET IN THE CITY OF MARICOPA FOR FISCAL YEAR 2024-2025 PROPOSED BY: Eric G. Ziegler
MEETING DATE: February 27, 2024

RECOMMENDATION
1) Mayor to open Public Hearing
2) Staff Report to City Council
3) Mayor to invite evidence and testimony from Maricopa residents re Unmet Transit Needs
4) In the absence of further testimony, Mayor to close Public Hearing re Unmet Transit Needs
5) City Council discussion of Unmet Transit Needs as warranted 6) Consider Motion to Adopt Resolution Entitled a Resolution of the City Council Of the City of Maricopa Finding that there are No Unmet Transit Needs Which Can be Reasonably Met in the City of Maricopa (FY 2024-2025)

BACKGROUND
In 1972, the California Legislature adopted a law known as the Mills-Alquist-Deddeh Act (also known as the Transportation Development Act or TDA) the purpose of which was to provide public transit service within California cities and counties. A portion of the state's sales tax revenue was set aside for use in funding this effort. Funds are administered by local Councils of Government (in Maricopa's case by KernCOG).

Under provisions of the act, local governments are expected to use TDA funds to serve the transit needs of the community. To the extent an individual city has funding in excess of that required to serve the community's transit needs, that excess funding may be spent on certain street, road and highway maintenance and repair services/projects. In Maricopa's case, the city's transit contract with the city of Taft and city street lights are funded with TDA money. The city pays for these services "upfront" and submits periodic claims to KernCOG for TDA reimbursement.

In order to ascertain whether transit needs have been met, local city councils are required to conduct a public hearing to receive evidence and testimony from residents of the community to determine the city's additional transportation needs, if any. It is important to note, for example, that the criterion for determining unmet transit needs is that of reasonableness. For example, it may not be reasonable to provide daily transportation from Maricopa to Los Angeles even if one or two people believe the city should do so.

Staff has advertised a public hearing for tonight's meeting in the Taft Midway Driller, an adjudicated newspaper of general circulation serving the Maricopa area. A copy of the Proof of Publication is attached hereto. It is therefore appropriate for Council to 1) open the public hearing; 2) receive the staff report on this issue and to then 3) Receive Evidence and Testimony from Maricopa Residents re Unmet Transit Needs; 4) After Receiving Evidence and Testimony re Unmet Transit Needs, close the Public hearing.

After the public hearing is closed, Council may discuss issues arising from the Public Hearing, if any, and, if warranted by evidence and testimony presented during the Public Hearing, consider a motion to Adopt a Resolution Entitled A Resolution of the City Council of the City of Maricopa Finding that There are No Unmet Transit Needs Which Can be Reasonably Met in the City of Maricopa for the Fiscal Year 2024-2025.

AGENDA ITEM
TITLE: Accept Proposal for Sewer Rate Study From AM Consulting Engineers and Authorize City Administrator to Execute Necessary Documents on Behalf of the City.

PROPOSED BY: Eric G. Ziegler
MEETING DATE: February 27, 2024

RECOMMENDATION
Motion to Accept Proposal for Sewer Rate Study From AM Consulting Engineers and Authorize City Administrator to Execute Necessary Documents on Behalf of the City.

BACKGROUND
As Council is aware, the city has experienced a significant increase in cost associated with operation and maintenance of the city's sanitary sewer system. These cost increases resulted in a substantial deficit in the city's Sewer Fund in the fiscal year ending June 30, 2023.

Several years ago, as part of the planning for improvements to the city's sanitary sewer system AM Consulting Engineers conducted a sewer rate study which addressed the projected cost associated with operating the city's sanitary sewer system for each year over a five year period This study served as the foundation for setting sewer rates for residents served by the Maricopa sewer system for a five year period between. 2018/2019 and 2022/2023.

The existing rate schedule has expired (meaning that we have authority to levy sewer fees at the current rate which has proven insufficient to cover O&M cost but lack the authority to increase existing sewer fees without a current sewer rate study and a successful Proposition 218 proceeding).

Attached hereto is a proposal for updating the city's most recent sewer service rate study from AM Consulting Engineers. The specific tasks to successfully accomplish this are specified in the proposal. Cost of the proposed study is a lump sum payment of $15,000.

Staff also solicited and reviewed a second proposal for the proposed rate study. Cost of the alternate proposal was a not-to-exceed price of $33,500.

Staff is recommending that Council favorably consider the sewer rate study proposal submitted by AM Consulting Engineers. The reasons for this recommendation are
1) AM Consulting Engineers successfully completed the original rate study in 2018. Given that the proposed rate study is simply an update of the prior study, AM has much of the information necessary to execute the study in a timely manner as opposed to having to start from scratch 2) Because they have been heavily involved in planning and designing the impending sewer improvement project, they are intimately acquainted with most aspects the system 3) The proposed cost of the study favors AM Consulting Engineers ($15,000 lump sum vs $33,500 not-to- exceed.)
4) The city currently has an existing contract with AM Consulting Engineers. Selecting the AM fee study proposal means that the proposed study can be added as an addendum or change order to the existing contract. This allows us to avoid a prolonged procurement process, especially given that time is of the essence because of the county's timetable for adding sewer assessments to this year's tax roll, 5) Staff believes that the proposed $15,000 is an eligible expense under the existing funding agreement with the State Water Resources Control Board. Should the cost of the study prove ineligible under the funding agreement, the city will be responsible for the $15,000 cost. Either way, the city must do a current sewer rate study in order to increase the sewer fees and eliminate losses in the city's sewer fund. or these reasons, staff recommends that Council tavorably consider a Motion to Accept Proposal for Sewer Rat tudv From AM Consulting Engineers and Authorize Citv Administrator to Execute Necessarv Documents on Behalf o City Adm.

Re: Proposal to Conduct Sewer Rate Study
Dear Mr. Ziegler,
AM Consulting Engineers (AMCE) is pleased to submit this letter proposal to conduct a sewer rate study for the City of Maricopa (District). It is our understanding that the City is seeking a comprehensive rate update for its sewer fund. The City's goal is to develop a sound financial plan that will ensure the community's ability to adequately fund the sewer utility and pay its financial obligations.

SCOPE OF SERVICES
Based on our understanding of the City's requirements for the rate study and our professional experience we have developed the following work tasks to complete the sewer rate study.

In general, any utility rate study begins by determining the revenue requirements to adequately provide a service and a structure to allocate costs to the customers based on their demands of that service. This proposal includes the following tasks:

Task 1 - Kickoff meeting and Data Collection
AMCE will schedule a project kickoff meeting with City staff. The goal of the kickoff meeting will be to confirm the study goals and provide an update of the project schedule.

Prior to the kickoff meeting, AMCE will provide the City a list of data needs including at a minimum historical and projected financial, operational, billing and planning information sewer ordinances, anticipated capital expenditures in the sewer system. The expectation is that City staff will gather the requested information and provide it to us at the kickoff meeting. The data will be reviewed, analyzed and validated for inclusion in the study process.

Task 2 - Calculate Revenue Needs
This task will determine the City's revenue needs for the sewer fund. The budget estimates will be used as a baseline for projecting future costs and revenues. AMCE will work with District staff to forecast annual operating expenditures for the planning horizon.

AME's projections will model financial impacts resulting from any known or anticipated operational costs additional or savings such as the results of energy efficiency improvements, conservation programs, and/or regulatory requirements. The projections will also incorporate the City's existing debt issues and any anticipated new issues in the revenue requirements. Debt service coverage requirements will be monitored.

Page 2 ends

Task 3 - Determine Cost of Service
The objective of this task is to provide a basis for allocating water service and sewer service costs to residents and businesses. The costs will be allocated based on customer data, engineering/planning criteria, and judgment, to assign utility costs recovery to customers in proportion their actual demands.

AMCE will review current assumptions regarding the total and the average discharge (quantity and quality) from each customer classification. If significant discrepancies are found in any of the customer classifications, AMCE will provide recommendations to revise the existing assumptions.

Task 4 - Rate Design
This task includes the development of updated sewer charges that are consistent with community goals.

For comparison purposes, AMCE will also collect rate structure information from neighboring cities and Special Districts for comparison with the current and proposed sewer rates.

AME's will review the City's existing rate structure and, if necessary, recommend updated rates. The goals of the rate structure are to provide a fair allocation of costs, be consistent with the City's fiscal policies, and generate sufficient revenue to meet the revenue requirement forecast.

Task 5- Draft Sewer Rate Study Report
Using the information developed in Tasks 1 through 4, AMCE will prepare the Sewer Utility Rate Study Report. AMCE will work closely with City staff throughout the preparation of the report. The Rate Study Report will include an executive summary, background assumptions, methodology used in the determination of the new sewer rates, findings and conclusions. Draft copies of each of the rate study reports will be submitted to the City for review and comment.

Task 6 - Presentations to City Council
Upon completion of the Draft Rate Study Report, AMCE will prepare a presentation to the City Council. The goal of the presentation will be to discuss the preliminary findings and conclusions of the report and to answer any questions. The presentation will include easy-to-read graphics and handouts of the study assumptions, methodologies, findings and conclusions. A questions and answers period will be provided to the City Council or Public. Review comments will be incorporated into the Final Rate Study Report.

Task 7- Final Sewer Rate Study Reports
After the review meeting with City staff and the City Council public presentation, AMCE will incorporate review comments into the Rate Study Report and prepare a Final Rate Study Report. Copies of the Final Sewer Rate Study Report will be prepared and submitted to the City. An electronic copy in PDF format will also be provided.

FEE
AMCE will complete the tasks set forth herein for a lump sum fee of $15,000. AMCE will invoice the City monthly for the work performed during the prior month based upon the estimated percentage of completion of the various tasks.

SCHEDULE
Our proposed schedule includes a draft of the rate study report in 60 days based on the delivery of all the project information requested at the kickoff meeting. AMCE is committed to the milestones presented in our schedule and has the resources to meet that schedule.
