BACKGROUND
In recent years, the city has encountered a noticeable number of persons unlawfully occupying buildings and structures within its jurisdiction. One way to reduce these unlawful occupancies is to control the availability of utility connections to these premises.

Attached hereto is a proposed ordinance intended prevent illegal hook ups to City sewer services and to establish procedures to ensure that bulldings and structures to be provided with water are properly permitted to be occupied and have obtained all proper permits and paid all appropriate fees and charges to the city.

The ordinance, prepared by the City Attorney, requires notice that the water utility provide the city with written notice of proposed connections, reconnections, disconnections and receive permission from the city to make any such connection.

Staff believes that these requirements are not particularly disruptive for the city's water purveyor and, over time, will help to reduced unlawful occupancies of buildings and other structures within the city.

Staff believes that It is appropriate at this time for Council to 1) Conduct Public Hearing Re An Ordinance Of The City Council Of The City Of Maricopa Adding Chapter 13.20 To The City Of Maricopa Municipal Code Related To Water Connections: 2) Waive Reading Of An Ordinance Entitled An Ordinance Of The City Council Of The City Of Maricopa Adding Chapter 13.20 To The City Of Maricopa Municipal Code Related To Water Connections; 3) Introduce An Ordinance Of The City Council Of The City Of Maricopa Adding Chapter 13.20 To The City Of Maricopa Municipal Code Related To Water Connections

AGENDA ITEM
TITLE Adopt Ordinance Entitled An Ordinance Of The City Council, Of The City Of Maricopa Amending Chapter 13.12 City Of Maricopa Municipal Code Regarding Mandatory Sewer Connections By Adding Section 13.12.015.

PROPOSED BY: Eric G. Ziegler
MEETING DATE: May 28, 2024

RECOMMENDATION
Motion to adopt an ordinance entitled An Ordinance Of The City Council, Of The City Of Maricopa Amending Chapter 13.12 City Of Maricopa Municipal Code Regarding Mandatory Sewer Connections By Adding Section 13.12.015

BACKGROUND
At the regularly scheduled meeting of Tuesday, May 14, 2024, Council conducted an advertised Public Hearing to receive public comment concerning adoption of an ordinance entitled An Ordinance of the City Council of the City of Maricopa Amending Chapter 13.12 City Of Maricopa Municipal Code Regarding Mandatory Sewer Connections By Adding Section 13.12.015 Mayor Morse opened the Public Hearing, received comments/input from both proponents and opponents wishing to address the Council, if any, after which the Mayor closed the Public Hearing and placed the matter before the Council for discussion.

Council subsequently adopted 1) a motion to waive the reading of the proposed ordinance; 2) a motion to introduce An Ordinance of the City Council of the City of Maricopa Amending Chapter 13.12 City Of Maricopa Municipal Code Regarding Mandatory Sewer Connections By Adding Section 13.12.015 The proposed ordinance is now before the City Council for adoption.

Attached hereto are three documents that address the current proposal re adopting an ordinance entitled An Ordinance Of The City Council, Of The City Of Maricopa Amending Chapter 13.12 City Of Maricopa Municipal Code Regarding Mandatory Sewer Connections By Adding Section 13.12.015

1. A Staff Report presented to the City Council at the regularly scheduled meeting of June 23, 2020 entitled Response to State Water Resources Control Board Inquiry re "How Does the City of Maricopa Propose to Assure that All Properties in the City Served by the City's Sanitary Sewer System Are Connected to the Sewer System"

2. Minutes of the regularly scheduled City Council meeting of June 23, 2020 documenting unanimous adoption of "Motion by Crump for Council to adopt the ordinance(s) and apply for the grants and loans necessary to implement The proposals."

3. Letter from City Administrator to AM Consulting Engineers dated July 10, 2020 informing them of the Council's June 23 decision in response to the State Water Resources Control Board's inquiry.

These documents and this decision ultimately enabled the city to pursue and eventually win funding for the sewer replacement/extension from the State Water Resources Control Board.

As Council is aware, the sewer project was recently bid with sealed bids publicly opened and read at 2 p.m. Wednesday, March 27, 2024. Three bids were received, the lowest being $14,960,779; high bid was $23,478,000. All bids were considerably above Procedurally, staff understands that the consultant has submitted the low bid package to the State Water Resources Control Board for review and final budget approval including a potential budget modification to address higher than anticipated bids. is appropriate at this time for Council to honor the commitments the city made at the time the funding agreement was approve which is to adopt the required ordinances, policies and other requirements necessary to implement and advance the propose projects). Failure to honor these commitments may have negative consequences including failure to complete a needed project and a demand to reimburse the SWRCB for funds provided to date.

It is appropriate at this time for Council to adopt an ordinance entitled An Ordinance Of The City Council, Of The City Of Maricopa Amending Chapter 13.12 City Of Maricopa Municipal Code Regarding Mandatory Sewer Connections By Adding Section 13.12.015

3 Elect to abandon the grant application process. This alternative seems the least desirable given that the city has and will continue to have myriad sewer problems in future years without replacing existing sewers at an desirable if the city hopes to see any development in the coming years.

BACKGROUND
In July, 2016, the city was awarded a $500,000 Wastewater Planning Grant by the State Water Resources Control Board for the purpose of planning and applying for a grant to reconstruct and extend the city's Sanitary Sewer System.

Subsequently, the city contracted with A&M Engineering of Fresno to perform the work necessary to prepare and submit a grant application including evaluations of the present system, environmental studies and other documentation as appropriate.

After four years, the application is pending with the State Water Resources Control Board. At this point, however, a question has arisen from the state as to what actions the city will take to this question arises very late in the application process, it is equally apparent that the state is unwilling to invest several million dollars in improving the city's sewer system without some As Council is aware, most of the lots in the city which have been owned by various oil companies for the past 100 years or more have been sold to private interests and will be marketed to the public in the immediate future. Given that many, if not all, of these lots will eventually be developed, the matter of assuring these lots eventually connect to the city sewer System is to simply condition issuance of a Certificate of Occupancy for any new residential, commercial or industrial structure upon connection to the city's sewer system.

With respect to existing structures not connected to a reconstructed/extended sewer system, the city may adopt an ordinance compelling the owners of such properties to connect to the system at their own expenses when certain triggering events occur. For example, such an event may be based on the passage of a certain amount of time of this after sewer service is available. This is property owners might be required to connect to the system within 36 months after Notice of Completion of sewers serving the property. A second possibility is to require connection if property improvements are made to an existing structure with an aggregate value in excess or a threshold amount such as $5,000. Connection cost is the property owners responsibility. All connections would be made under permit by a licensed contractor qualified to make such connections.

Recognizing that Maricopa may qualify as a disadvantaged community and acknowledging that there are many low/moderate income families in the city, it would be appropriate for the city to provide assistance in financing the cost of connection to the sanitary sewer system if it is able to do so. While the city clearly does not have sufficient resources to do so, there are certain grant and/or long term loan programs available that might address this need.

To that end, staff would propose that as part of a required connection program, the city commit to applying for Community Development Blok Grant funds for the purpose to making grants and/or long term loan programs available to low/moderate income property owners to connect to the sewer system. If the city were able to procure such a grant, it might make funds available on a grant basis to very low or low income property owners to connect to the system. For moderate income properties, the city may make long term loans available to connect for the system. Such loans might be payable at no or low interest over 20 years, collected on the tax rolls. In the alternative, such a loan may simply be recorded as a lien against the property and be payable when the property transfers ownership. Typically, a CDBG grant used for such a purpose creates a revolving loan program in which the city tracks both revenue and expense for an ongoing fund. As loans are paid, the recovered money is available to make new loans to other property owners.

In addition to or as a supplement to a CDBG grant for the above purpose, the city may apply for a long term USDA or other loan to provide long term loans to qualified property owners for connection purposes. Terms of such loans would be similar to those cited above if allowed by the loaning agency.

It must be noted that the proposals noted herein were formulated by staff as a way of removing whet seems to be the final barrier to securing the grant needed to reconstruct and expend the city's sewer system. These proposals assume that grants and loans of the type proposed are acceptable to the granting agency. Past experience with these programs suggests that these would be eligible uses for income qualifying property owners.

Staff also notes this if Council approves these programs tonight, staff will submit the proposals to the state in answer to the question of how the city intends to assure that properties served by the sanitary sewer system are connected to the system.

Lastly, if Council approves these proposals for submission to the state, staff assumes that the any sewer construction grant will be contractually contingent upon the city taking the proposed actions as a condition of the grant contract between city and the State Water Resources Control Board.

Recommendation:

1. Motion to Approve Proposals Discussed Herein to Resolve Issue of How the City will Assure Connection of Properties to City Sanitary Sewer Service Once Such Services is Available to A Particular Parcel. (This Action basically commits the Council to adopt the ordinance(s) and apply for the grants and loans necessary to implement the proposals, probably as a condition of the grant.

Assuming the City is awarded and accepts a grant to reconstruct and extend its existing sewer system, failure to pursue these programs may cause the State to pursue recovery of several million dollars in grant funds at some future date.)
- OR -

2. In the alternative, Provide Direction to Staff re How the City will Assure Connection of Properties to City Sanitary Sewer Service Once Such Services is Available to A Particular Parcel - OR.-
3 Elect to abandon the grant application process. This alternative seems the least desirable given that the city has and will continue to have myriad sewer problems in future years without replacing existing sewers at an absolute minimum. Added to this is that without grant funds, there is no possible way for the city to replace the current system much less expanding it to serve the entire city.

And expanding the sewer system is desirable if the city hopes to see any development in the coming years.

Motion by Crump for Council to adopt the ordinance(s) and apply for the grants and loans necessary to implement the proposals

With respect to the City of Maricopa's State Water Resources Control Board Grant Application, you have asked the city to address the manner in which it will assure that properties served by the reconstructed/extended sanitary sewer system will ultimately connect to the system.

The answer is that the City of Maricopa is part of a Local Agency Management Program (LAMP) for Onsite Waste Water Treatment Systems (OWTS) in Kern County. The LAMP has been approved by the State Water Resources Control Board as it meets the Board's OWTS Policy.

The LAMP is administered by Kern County through its Environmental Health Department which is responsible for issuing OWTS permits. Such permits are not issued by Environmental Health for either a new OWTS or for repairs to an existing OWTS if a City sanitary sewer line is available within 200 feet of the OWTS site.

Assuming that reconstruction/extension of the city's existing sanitary sewer system can be expeditiously accomplished, this effectively requires a property to connect city's sanitary sewer system when a currently vacant site is being developed with a residential, commercial or industrial structure; properties with existing structures served by an OWTS must connect to the system when an existing septic tank fails.

With respect to existing structures, the City of Maricopa qualifies as a disadvantaged community.

The city certainly acknowledges that there are many very low/low/moderate income families in the city that will find it financially difficult to connect to the city's sanitary sewer system when an existing OWTS fails. Ideally, it would be desirable for the city to provide assistance in financing the cost of connection to the sanitary sewer system for very low/low/moderate income families were it able to do so. While the city clearly does not have sufficient resources to do so, there are certain grant andor long term loan programs available that might address this need.

To that end, the City of Maricopa would propose that given the sanitary sewer connection required under the LAMP, the city commit to applying for Community Development Block Grant (CDBG) funds for the purpose of making grants and/or long term no/low interest loan programs available to very low/ low/moderate income property owners to connect to the sewer system.

Were the city able to procure such a grant, it would propose to make funds available on a grant basis to very low or low income property owners to connect to the system. For moderate income properties, the city would propose to offer qualified property owners a long term no/low interest loan to connect for the system. Such loans might be payable at no or low interest over 20 years, collected on the tax rolls. In the altemative, such a loan may simply be recorded as a lien against the property and be payable when the property transfers ownership. Typically, a CDBG grant used for such a purpose results in creation of a revolving loan program in which the city tracks both revenue and expense for an ongoing fund. As loans are paid, the recovered money is available to make new loans to other property owners.

In addition to or as a supplement to a CDBG grant for the above purpose, the city may apply for a long term loan from the U.S. Department of Agriculture (USDA) or similar source to provide long term loans to qualified property owners for connection purposes. Terms of such loans would be similar to those cited above if allowed by the lending agency.

It must be noted that the proposals noted herein were discussed and tentatively agreed to by the Maricopa City council at its regularly scheduled meeting of Tuesday, June 23, 2020.

I regret that the city has been somewhat sluggish in response to this inquiry. But the fact is that Maricopa is a small community with few resources and limited staff, both of which have been negatively impacted by the current corona virus pandemic. Hopefully this response will address the concerns expressed and allow the Board to successfully proceed with the city's grant application.

AGENDA ITEM
TITLE: Adopt Resolution Entitled A Resolution of the City Council of the City of Maricopa Adopting a List of Projects for Fiscal Year 2024-25 Funded by SB 1: The Road Repair and Accountability Act Of 2017 PROPOSED BY: Eric G. Ziegler
MEETING DATE: May 28, 2024

RECOMMENDATION
Motion to Adopt Resolution Entitled A Resolution of the City Council of the City of Maricopa Adopting a List of Projects for Fiscal Year 2024-25 Funded by SB 1: The Road Repair and Accountability Act Of 2017

BACKGROUND
The Road Repair and Accountability Act of 2017, also known as SB 1 is was adopted by the legislature with the aim of repairing roads, improving traffic safety, and expanding public transit systems across the state. The bill imposed an additional 12 cents a gallon on the state gasoline tax and 20 cents a gallon on diesel fuel. It was anticipated that these increases would generate an additional $5.24 billion per year for the bill's stated purposes.

One provision of this bill subvenes a certain portion of this additional revenue to cities and counties to supplement existing resources for the repair of local streets and roads throughout California.

In order to received funds from the SB1 gas tax, each California city is required to adopt by resolution a list of projects proposed to be funded in whole or in part by those revenues. In April, 2018, the city adopted a resolution specifying projects to be funded with SB1 revenue for the 2018 - 2019 fiscal year; it adopted similar resolutions in succeeding fiscal years, the most recent such resolution being adopted in fiscal year 2022-23. Because of Maricopa's small size, the city's allocation of SB1 revenue is rather modest, in the area of $20,000 +/- per year. These funds can be carried over to subsequent fiscal years which allows the city to accumulate funds toward completion of one or more specified projects. The cumulative total of these funds over the multiple FY period is approximately $80,000+/-. This should at least allow the city to undertake a modest street maintenance project cited below in the fall of 2024.

The project in question as adopted by the City Council is rehabilitate certain streets by crack-filling and chip sealing portions of streets in the city of Maricopa in which sewer replacement work had been completed. These were portions of Union Street, Adeline Street, Mary Street, Broadway Street, Helen Street, and Bush Street.

Deadline for submitting this resolution is on or before July 1, 2024.

Staff recommends that Council favorably consider a motion to Adopt Resolution Entitled A Resolution of the City Council of the City of Maricopa Adopting a List of Projects for Fiscal Year 2024-25 Funded by SB 1: The Road Repair and Accountability Act Of 2017

AGENDA ITEM
TITLE: Authorize Staff to Give 30 Day Notice to Terminate Agreement for Payroll Processing Services etween the City of Maricopa and Every Penny Counts and to Negotiate Agreement with for Payro rocessing Services with Payroll Plus and Authorize Mayor to Execute Agreement on Behalf of th City.

PROPOSED BY: Eric G. Ziegler
MEETING DATE: May 28, 2024

RECOMMENDATION
Authorize Staff to Give 30 Day Notice to Terminate Agreement for Payroll Processing Services Between the City of Maricopa and Every Penny Counts and to Negotiate Agreement with for Payroll Processing Services with Payroll Plus and Authorize Mayor to Execute Agreement on Behalf of the City.

BACKGROUND
In November 2023, staff was informed that the owner of Payroll Plus, our city's payroll service for 16 years would be retiring for medical reasons as of December 31, 2023.

At that time, regular payrolls were processed bi-weekly, through Payroll Plus who processes all payroll checks and direct deposits, calculates payroll figures, withholding taxes, such as federal, state and local taxes, benefits and other with holdings and/or garnishments. Payroll Plus service also prepares quarterly and annual payroll reports, including payroll tax filings, W-2s and other related reports and stays current with all new payroll tax laws In order for payroll to remain current and uninterrupted, and given that the city's payroll processing has been outsourced for 16 years, well before any of the current staff were hired, current staff has no experience in processing payrolls and related reports. Thus, it was and is in the cities' best interest to procure a new payroll processor as quickly as was reasonably possible.

After soliciting quotes from three payroll services, the city contracted with a vendor in Taft to provide sought after services at a cost of $2600 per year After contacting clients, staff was satisfied with responses, which were highly favorable toward the company. A proposed one year agreement for required services is attached. The agreement has a termination clause which permits either party to terminate the agreement with 30 days written notice.

Regrettably, the current payroll service has some systemic shortcomings that are not helpful to the city. In the past five months, payroll has been late on three occasions. This has required the city to issue handwritten checks to its employees and to seek reimbursement of late checks which ended up being duplicate checks. WE are also experiencing problems with some of the reports we're required to file with state and federal taxing authorities.

It appears that these problems arise as a result of differences in the software systems used by the city and its current payroll services.

Staff is informed that the owner of our former payroll service has recovered her health and is again accepting clients.

Given that the city has a long and mutually beneficial relationship this this company without issues, staff recommends that the city terminate its agreement with the current payroll processor and move its account back to Payroll Plus effective immediately.

Staff recommends the Council favorably consider a Motion to Authorize Staff to Give 30 Day Notice of Termination of Agreement for Payroll Processing Services Between the City of Maricopa and Every Penny Counts and to Negotiate Agreement with for Payroll Processing Services with Payroll Plus and Authorize Mayor to Execute Agreement on Behalf of the City.
