BACKGROUND
In recent years, the city has encountered a noticeable number of persons unlawfully occupying buildings and structures within its jurisdiction. One way to reduce these unlawful occupancies is to control the availability of utility connections to these premises.
Attached hereto is a proposed ordinance intended prevent illegal hook ups to City sewer services and to establish procedures to ensure that buildings and structures to be provided with water are properly permitted to be occupied and have obtained all proper permits and paid all appropriate fees and charges to the city.
The ordinance, prepared by the City Attorney, requires notice that the water utility provide the city with written notice of proposed connections, reconnections, disconnections and receive permission from the city to make any such connection.
Staff believes that these requirements are not particularly disruptive for the city's water purveyor and, over time, will help to reduced unlawful occupancies of buildings and other structures within the city.
Staff believes that It is appropriate at this time for Council to 1) Conduct Public Hearing Re An Ordinance Of The City Council Of The City Of Maricopa Adding Chapter 13.20 To The City Of Maricopa Municipal Code Related To Water Connections: 2) Waive Reading Of An Ordinance Entitled An Ordinance Of The City Council Of The City Of Maricopa Adding Chapter 13.20 To The City Of Maricopa Municipal Code Related To Water Connections; 3) Introduce An Ordinance Of The City Council Of The City Of Maricopa Adding Chapter 13.20 To The City Of Maricopa Municipal Code Related To Water Connections

Mr. Ziegler:
The purpose of this letter is to provide the City of Maricopa (City) with the comments of West Kern Water District (District) regarding the City's proposed Ordinance Related to Water Connections (Ordinance).
The District is a County Water District, formed and functioning pursuant to Water Code section 30000, et seq. The District provides water services to municipal, commercial, and industrial customers throughout Taft, Maricopa, and the surrounding areas. In doing so, the District has constructed hundreds of miles of distribution pipelines and associated water service connections, including pipelines and connections that provide potable water to the City's residents.
While the District fully appreciates the City's purpose for proposing the Ordinance, the District has the following questions and concerns:
Throughout the Ordinance, two terms are used that have technical meaning to the District, but no clear definition in the Ordinance. Those two terms are "sérvice" and "connection."
First, section 13.20.10 provides that:
The purpose of this chapter is to prevent illegal hook
ups to City sewer services and to establish procedures
to ensure that buildings and structures to be provided
with water are properly permitted to be occupied and
have obtained all proper permits and paid all
appropriate fees and charged to the [Clity."
Section 13.20.10's use of the phrase "hook ups to City sewer services" leads the District to believe that the term "connection, ," as used throughout the Ordinance, refers to sewer service connections, not water service connections.
West Kern Water District - 800 Kern St., P.O. Box 1105 • Taft, California 93268-1105 - 661-763-3151 • 661-765-5435 This distinction is important as the City retains jurisdiction over sewer services, and the District retains jurisdiction over water services. The District request clarity here as to the City's intended meaning.
Assuming, however, that the term "connection" does apply to water service connections, the District is concerned regarding the City's seemingly interchangeable use of the terms "service" and "connection." For example, section 13.20.30 provides, "Iflor buildings, structures and/or lots that have previously received water service no water provider either public or private shall reconnect any building, structure or lot to water service without first notifying the City in writing and receiving permission from the City to do so." When the District discontinues water service to an accountholder, it does not disconnect any infrastructure.
The District recommends that the City revise the Ordinance to focus on disconnections and reconnections to water service infrastructure, not the stopping and restarting of water service.
As written, if an accountholder's building, structure, or lot falls out of compliance with the City's ordinances and/or regulations, or if the accountholder becomes delinquent in any fees and/or charges to the City, then that accountholder could not request water service without violating the Ordinance. (See § 13.20.50.) And, consequently, if the District provided that accountholder with water service, there is a chance that it too would be in violation of the Ordinance. What the Ordinance fails to consider is that the District in unable to discontinue such water service due to its mandated compliance with Senate Bill 998, otherwise referred to as the "Water Shutoff Protection Act" (Act). The Act requires that the District have a written policy on the discontinuation of residential water service for non-payment.' The District's policy sets forth a 60- day process to discontinue water service to its accountholders. So, the District would be forced to provide that accountholder with water services throughout the duration of the 60 days. Assuming that the City would impose a $500 per day penalty, the District would incur a bill of $30,000 just for complying with the law.
Instead of focusing on water service, the City should revise the Ordinance to address water service connections. It is much more reasonable that the District inform the City of connections and disconnections to water service infrastructure and seek approval from the City for those connections or reconnections.
Further, the District is unclear as to how the Ordinance will actually be enforced. Section 13.20.50 provides:
No person or entity shall request water service from a
water provider either public or private, to a building, structure or lot unless such building, structure or lot is properly permitted and all fees and charges have been
paid in full to the City and the building, structure or lot is in full compliance with all the ordinances and
regulations of the City.

Box 1105 - Taft, California 93268-1105 • 661-763-3151 • 661-765-5435 The District does not know whether a building, structure, or lot is properly permitted, up to date on all fees and charges, or in compliance with all City ordinances and regulations. It is also unclear whether this section applies to existing accountholders. If so, the onus should not be on the District to confirm whether or not each of its accountholders receiving water service from the District of noncompliance by an accountholder, the District could not District is in compliance with this section. Even if the City were to inform the discontinue water service due to compliance with the State law, as discussed above. This District recommends that the City strike this section entirely.
The District is even more concerned with section 13.20.60, which provides:
No person or entity shall have a connection to water
service to any building, structure or lot if said building, structure or lot is not properly permitted by the City and all fees and charges have been paid in full to the City and the building, structure or lot is in full compliance with all the ordinances and regulations of the City.
Unlike section 13.20.50 above, this section clearly applies to existing water service connections and would therefore require the District to perform a review and analysis of each existing connection to confirm whether or not the building, structure, or lot that is connected to the District's infrastructure is properly permitted, up to date on all fees and charges, and in compliance with all City ordinances and regulations. Again, this burden should not be on the District. The service connections. District recommends that the City revise this section to only apply to future water We understand that the City intends to consider and possibly adopt the Ordinance on Tuesday, May 28, 2024. We respectfully request that the City table this item so that the City and the District can work together on revisions to the Ordinance that accomplish the City's desired outcome and avoid undue burden on the District and its accountholders.
Please feel free to contact me directly at 661-763-3151ext. 105 or [email protected] so that we may discuss this matter further.
Thank you for your time and consideration.

TITLE: Introduction of Ordinance Entitled An Ordinance Of The City Of Maricopa Imposing An Additional Transactions And Use Tax For Essential General Fund Services To Be Administered By The State Board Of Equalization PROPOSED BY: Eric G. Ziegler
MEETING DATE: June 11, 2024
RECOMMENDATION
1. Motion to waive reading of an ordinance entitled An Ordinance of the City Of Maricopa Imposing An Additional Transactions And Use Tax For Essential General Fund Services To Be Administered By The State Board Of Equalization
2. Motion to introduce an ordinance entitled An Ordinance Of The City Of Maricopa Imposing An Additional Transactions And Use Tax For Essential General Fund Services To Be Administered By The State Board Of Equalization
BACKGROUND
At the regularly scheduled meeting of Tuesday, March 12, 2024, Council directed staff to prepare documents - necessary for placing a sales tax increase ordinance on the November ballot.
Attached hereto is a proposed ordinance for Council consideration as well as a proposed resolution placing the ordinance on the November 5, 2024 ballot for voter consideration. This ordinance, if adopted by a 2/3 vote of the City Council and adopted by a majority of Maricopa voters voting in the November election would raise the sales tax for transactions occurring within the city by one percent. Assuming that such an increase is not a "deal breaker" for purchases occurring in the city of Maricopa, adoption of the ordinance would effectively double the city's sales tax revenue in the first full fiscal year of the one percent increase which represents a potential additional $40,554 in general fund revenue during the first year of implementation.
In addition to adoption of the ordinance by a 2/3 vote of the City Council, adoption of the accompanying resolution is necessary to place the matter before the voters. Because it requires two meetings to adopt an ordinance...a regularly scheduled meeting at which the ordinance is introduced and a second regularly scheduled meeting at which the ordinance is adopted, staff recommends delaying action on the proposed resolution until the next meeting at which Council considers actual adoption of the proposed ordinance.
Should Council wish to pursue adoption of the proposed ordinance and placement on the November ballot, it is appropriate to consider a motion to waive the reading of an ordinance entitled An Ordinance Of The City Of Maricopa Imposing An Additional Transactions And Use Tax For Essential General Fund Services To Be Administered By The State Board Of Equalization.
Assuming adoption of a motion to waive the reading, it is appropriate to consider a motion to introduce an ordinance entitled An Ordinance Of The City Of Maricopa Imposing An Additional Transactions And Use Tax For Essential General Fund Services To Be Administered By The State Board Of Equalization Again, it is important to note that the ordinance must be adopted by a 2/3 vote of the City Council which means by four votes on a five member city council.
Following adoption of the proposed ordinance, it is then appropriate to vote on the resolution submitting the ordinance to Maricopa voters at the November 5, 2024 election.
The following excerpt from the California Revenue and Taxation governs an increase in local sales tax:
7285.9. The governing body of any city may levy, increase, or extend a transactions and use tax for general purposes at a rate of
0.125 percent or a multiple thereof, if the ordinance proposing that tax is approved by a two-thirds vote of all members of that governing body and the tax is approved by a majority vote of the qualified oters of the city voting in an election on the issue. The governin ody may levy, increase, or extend more than one transaction and use tax under this section, if the adoption of each tax is in the manner prescribed in this section. The transactions and use tax shall conform to Part 1.6 (commencing with Section 7251).

RE: City Council Salary
Based on the comments made at the last City Council Meeting, I took a look at some issues related to City Council salaries.
Government Code section 36516 authorizes the city to provide to the city council members a salary of $300 per month based on Maricopa's population.
Government Code section 36516.5 also authorizes an increase in Council salaries in an amount not to exceed 5% for each calendar year from the operative date of the last adjustment. Thus, if the Council has not had a salary increase in the last twenty years, it can adopt an ordinance effectively doubling its salary: 20 X 5% = 100%.
The Attorney General has ruled that the maximum 5% per year percentage increase must be applied only once, with no compounding. 89 Ops. Cal.Atty.Gen. 159 (2006). You can only calculate the increase based on what the actual salary was, not on what is could have been. In other words, the city may not apply the 5% to the currently received salary amount only for the first year, and then apply it to the newly calculated amount for the second year, and continue these separate calculations for each intervening year. For example, if six years have passed since the last salary increase, only one calculation - an increase of 30% - is to be made, not six separate calculations, one on top of the other.
*A Professional Corporation
Government Code section 36516.5 prohibits any change in compensation during the council member's term of office. This does not mean that Councilmember X, elected in 2012, must wait until his next term of office begins in 2016. Because city council members serve staggered terms, Councilmember X will be eligible for an increase following the next municipal election in 2014, when two or three of his compatriots must run for reelection, even though X is in the middle of his own term.
Government Code section 36516(a)(4) also provides, in pertinent part, that "no ordinance shall be enacted or amended to provide automatic future increases in salary." The council may grant city employees a three year MOU, with cost of living increases on July 1 of each year of the contract. But it may not do so for The establishment of city council salary must be by ordinance, not resolution. (§36516(a)(4))
If there are any questions on this matter, please give me a call or ask me at the next City Council Meeting I attend.
