BACKGROUND
At the regularly scheduled Council meeting of Tuesday, May 14, 2024, Council reviewed a Draft Sewer Rate Study and authorized staff to initiate the Proposition 218 process re proposed sewer service fees starting Fiscal Year 2024-2025 through Fiscal Year 2029-2029.

On June 6, 2024, staff mailed (amended) Proposition 218 notices to all property owners having sewer service as listed on the most recent equalized tax rolls. Attached hereto as Exhibit B is a copy of the legally required notice of public hearing approved by the City Attorney.

The proposed sewer rates become effective starting in the Fiscal Year beginning July 1, 2024. The City is required by State law to collect revenues sufficient to cover the costs of operating the sewer system. These revenues allow the City to provide sewer service to the residents and businesses of Maricopa. Costs that must be recovered through rate revenues include utilities, equipment and supplies, treatment chemicals, salaries and benefits of City staff assigned to the operation of the sewer system. In addition, revenue generated from sewer rates is used to pay for capital improvements such as replacement of sewer pipes. Revenues are also used to pay off debt and to replace equipment.

Under the current sewer rates, future revenues will be insufficient to continue operating the sewer system. Therefore, a sewer rate increase is needed to generate revenues greater than operating expenses.

Under California law, an ordinance establishing sewer rates adopted in accordance with provisions of Prop 218 may increase rates annually for a period of five years.

Proposed rates for the second through fifth years of fee adjustment are based upon estimated cost increases over the period as noted in the Rate Study.

It is appropriate at this time for Council to conduct the Public Hearing required by Proposition 218. The hearing is governed by provisions of City Council Resolution 12-11, a copy of which is attached hereto as Exhibit A. The City Attorney will review hearing procedures for the Council and the public prior to the Mayor opening the Public Hearing.

Upon completion of the hearing, consider a motion to adopt resolution entitled A Resolution of the City Council of the City of Maricopa Declaring the Result of the Proposition 218 Protest Count for the Proposed New City Sewer Rates Because of time constraints on submitting rates to the county for inclusion in the FY 2024 - 2025 tax bills, it is necessary to consider adoption of an urgency ordinance establishing the revised rate. This ordinance becomes effective upon adoption allowing the city to proceed with assessment of rates pending adoption of a regular fee ordinance. Thus, in the absence of a majority protest, it is appropriate for Council to 1) consider a motion to waive the reading of an urgency ordinance of entitled An Urgency Ordinance of the City of Maricopa Amending the Maricopa Municipal Code by Amending Chapter 13.12, Section 13.12.040 Establishing New Sewer Rates; 2) Motion to adopt an ordinance entitled An Urgency Ordinance of the City of Maricopa Amending the Maricopa Municipal Code by Amending Chapter 13.12, Section

13.12.040 Establishing New Sewer Rates; 3) Motion to waive reading of an ordinance entitled An Ordinance of the City of Maricopa Amending Section 13.12.040 of the Maricopa Municipal Code Establishing New Sewer Rates; 4) Motion to introduce An Ordinance of the City of Maricopa Amending Section 13.12.040 of the Maricopa Municipal Code Establishing New Sewer Rates.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MARICOPA

ADOPTING PROCEDURES FOR ESTABLISHING AND INCREASING
FEES AND CHARGES UNDER PROPOSITION 218.

WHEREAS, Proposition 218 (Articles XIIIC and XIIID of the California Constitution) requires the City to comply with the substantive and procedural requirements set forth in section 6 of Article XIIID of the California Constitution prior to imposing or increasing a fee or charge upon any parcel of property or upon any person as an incident of property ownership; and
WHEREAS, Proposition 218 requires that the "record owner" of the parcel upon which the fee or charge is proposed for imposition or increase be notified of the amount of the fee, the basis upon which the amount of the fee was calculated, the reason for the fee, and the date, time, and location of a public hearing on the fee; and
WHEREAS, Proposition 218 requires that all protests against the fee or charge be considered at that public hearing; and
WHEREAS, Proposition 218 does not clearly set forth the meaning of "record owner" for purposes of the notice required by section 6 of Article XIIID; and
WHEREAS, Proposition 218 does not clearly set forth who is allowed to submit protests, the procedure for submitting protests, or how the protests are to be tabulated; and
WHEREAS, the City Council wishes to set forth procedures for these two issues in this resolution which are intended to be consistent with both Proposition 218 and with the Proposition 218 Omnibus Implementation Act.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Maricopa, that the following procedures shall be used when imposing or increasing a fee or charge subject to Article XIIID of the California Constitution:

Section One. Fee or Charge. For the purposes of this resolution, "fee or charge" means any levy other than an ad valorem tax, a special tax, or an assessment, imposed by an agency upon a parcel or upon a person as an incident of property ownership, including a user fee or charge for a property- related service.

Section Two. Property related Service. For purposes of this resolution, "property related service" means a public service having a direct relationship to property ownership.

Section Three. Notice. Prior to imposing a fee or charge, each parcel upon which the fee or charge is proposed for imposition shall be identified. The City Clerk shall mail written notice at least forty-five days prior to the date of the public hearing on the fee or charge to all owners whose names and addresses appear on the last equalized secured property tax assessment roll (as provided in Government Code § 53750(j)) at the address to which the City customarily mails the billing statement for an existing property related service delivered to that address. If the City intends to record or enforce a lien on the parcel to which service is provided, then notice shall also be mailed to the address shown on the last equalized assessment roll if that address is different than the billing or service address.

In addition to the persons identified in this section, the City Clerk shall also mail written notice to anyone who has submitted a request to receive notice of the imposition or increase of a fee or charge. Failure of any person to receive notice shall not invalidate the proceedings.

Section Four. Protest Procedure.

A. Any owners whose names and addresses appear on the last equalized secured property tax assessment roll and any persons who have signed up to receive the property related service for which the fee or charge may submit a written protest against the proposed fee or charge at the noticed public hearing or to the City Clerk, P. O. Box 548, Maricopa, CA 93252-0548. Verbal protests and written protests submitted by fax or e-mail and will not be considered by the City Council to determine whether a majority of the owners of the identified parcels have submitted protests. All members of the public are entitled to make comments at the public hearing whether or not they choose to submit a written protest.

B. All written protests must be submitted before the conclusion of the noticed public hearing. The City Clerk shall not accept or consider any protest that is received after the conclusion of the public hearing even if postmarked prior to that time.

C. Written protests must identify the affected property (by assessor's parcel number or street address) and must include the original signature of the person submitting the protest. The person signing the protest shall identify him or herself as either the owner of the parcel as shown on the last equalized security property tax assessment roll or as the person who signed up to receive the property related service for which the fee or charge is imposed
D. One written protest per parcel, submitted by the owner of the parcel whose name appears on the last equalized property tax assessment roll or submitted by the person who signed up to receive the property related service for which the fee or charge is imposed, shall be counted. If either the owner of the parcel whose name appears on the last equalized property tax assessment roll or the person who signed up to receive the property related service for which the fee or charge is imposed submits a written protest, that protest shall be included in the calculation of whether there is a majority protest against the fee or charge. If more than one person or entity owns the parcel, if one of the owners submits a written protest, that protest shall be included in the calculation of whether there is a majority protest against the fee or charge. Under all circumstances, only one protest per parcel shall be counted.

E. Any person who submits a written protest may withdraw it by submitting a written request that the protest be withdrawn in person at the public hearing or to the City Clerk, P. O. Box 548, Maricopa, CA 93252-0548, before the conclusion of the public hearing. The written withdrawal of a protest shall identify the parcel and the name of either the owner whose name appears on the last equalized secured property tax assessment roll or the person who signed up to receive the property-related service for which the fee or charge is imposed and include a request that the protest be withdrawn.

The withdrawal of a protest shall only be valid if it is submitted by the same person who submitted the protest.

F. Written protests shall remain sealed until the conclusion of the public hearing. From and after the time they are opened after the conclusion of the public hearing, the written protests shall constitute "public records" (as defined in Government Code § 6254). The City Clerk shall establish appropriate safeguards to ensure that the protests are not opened prior to the conclusion of the public hearing.

Section 5. Tabulation of Written Protests. The following procedures are hereby adopted for calculating whether a majority protest against a fee or charge has been received:

A. The City Clerk shall determine the validity of all protests. The City Clerk shall not accept as valid any protest if the City Clerk determines that any of the following:
i. The protest does not identify a parcel which receives the property related service for which the fee or charge is imposed
ii. The protest does not bear an original signature of the person submitting the protest.
iii. The protest does not state its opposition to the proposed fee which is the subject of the protest proceeding.
iv. The protest was not received by the City Clerk before the close of the public hearing on the proposed fee.
v. A request to withdraw the protest is received prior to the close of the public hearing on the proposed fee.

B. The City Clerk's decision regarding the validity of a protest shall constitute a final action of the City and shall not be subject to appeal to the City Council or to any other board or employee of the City.

C. The City Clerk shall begin tabulating written protests within twenty-four business hours following the close of the public hearing. The City Manager may retain a private firm with demonstrated experience in tabulating written protests to assist the City Clerk. If, at the conclusion of the public hearing, cursory review of the protests received demonstrates that the number received is manifestly less than one half of the parcels served by the City with respect to the fee which is the subject of the protest, then the City Clerk may advise the City Council of the absence of a majority protest without tabulating the protests.

D. A majority protest exists if, with respect to a majority of the parcels subject to the proposed fee, written protests which comply with each of the requirements of this Resolution are timely submitted and not withdrawn.

BE IT FURTHER RESOLVED, that this activity is not a project and therefore is not subject to the California Environmental Quality Act pursuant to CEQA Guidelines section 15060(c)(3).

I hereby certify that the foregoing Resolution was passed by the City Council of the City of Maricopa, at this special meeting thereof held this 17th day of April 2012.

BACKGROUND
On May14, 2024, the City of Maricopa adopted a new Sewer Rate Study (2024SRS). The 2024SRS analyzed the adequacy of revenues to meet projected expenditures of the sewer enterprise fund (the Fund) to determine whether the Fund will be adequate to cover recurring operating and maintenance costs as well as needed capital costs while supporting debt service obligations through Fiscal Year 2028/29. The recommendation of the 2024SRS is to implement new sewer rates for the next five years (i.e. through Fiscal Year 2028/29).

The 2024SRS provides explanation and justification of proposed sewer rates. The 2024SRS reviews the Fund's historical revenues and expenses and projects future year revenue requirements to be collected through sewer sales.

The 2024SRS is available for review at City Hall, 400 California Street, Maricopa, CA 93252 between 8:00 a.m. and 5:00 p.m., Tuesday through Friday. City staff can assist you with answering any questions about your sewer bill. If you have questions or need additional information, please contact City Hall (661) 769-8279.

WHY IS A SEWER RATE INCREASE NEEDED?

PROPOSED SEWER RATES
The proposed sewer rates maintain a flat rate based on customer class. Presented below are the proposed sewer rates and rate adjustments through Fiscal Year 2028/29. Customer classes are defined as follows:
• Class 1: Single-family residences, duplexes and Triplexes (per dwelling unit); • Class 2: Multiple-unit apartments with four or more dwelling units (per dwelling unit); • Class 3: Hotels/motels for owner/resident manager dwelling units (per dwelling unit); • Class 4: Hotels and motels per guest room;
• Class 5: Public assembly buildings including churches, synagogues, mosques and similar;
• Class 6: Public and private schools and colleges per one hundred students (ADA), or fraction thereof;
• Class 7: Commercial establishments not otherwise listed in this User Schedule of sewer service fees.

The following table shows that a residential home (Class 1) would currently pay $37.78 per month. Under the new rate structure that customer would pay $47.47 in Fiscal Year 2024/25.

The primary reasons for the increase in sewer bills are fully funding increased operations costs and paying for rehabilitation of existing sewer mains.

WHEREAS, a public hearing on the proposed new sewer rates was held on July 23rd, 2024, as specified in the Proposition 218 notice and at the end of the hearing, the City Council reported the results of the protest count; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Maricopa as follows:

1. Findings: The City Council finds and determines as follows:
a. There are 256 sewer service customers within the City which receive the City's sewer services and who received notice of the proposed new sewer rates. b. The sewer rates set forth in the Rate Study have been fixed in amounts sufficient to pay the projected operating, maintenance, capital improvement costs of the City's sewer system.

The new sewer rates are reasonably related to, and do not exceed, the City's cost of providing the sewer services for the City and will not be used for any other purpose.
d. The City has provided the required written notice in accordance with Article XIIID of the California State Constitution.
e. The City received a total of timely-filed protests.
f. The City Council conducted a duly noticed public hearing on July 23, 2024, at which time the public had the opportunity to speak to the City Council regarding the proposed increases and the City Council considered the testimony received prior to making a final decision to adopt the proposed rate.
g. The adoption of this resolution is exempt from the requirements of the California Environmental Quality Act ("CEQA") pursuant to Public Resources Code Section 21080(b)(8) and Section 15273 of the State CEQA Guidelines codified at 14 CCR §15273 because the resolution pertains to the adoption of rates necessary to maintain services with the City's existing service area.

2. Declaration of Results: The total number of valid protests timely received by the City does not constitute a majority of the rate payers mailed Proposition 218 notices.

Effect of Protests: The effect of the results of the protest count as described above is that the City Council is authorized to adopt the proposed sewer rates attached as Exhibit "A".

4. Effective Dates: This resolution shall be in full force and effect upon its adoption.

2) Receive evidence and testimony from members of public wishing to comment, protest or object to Garbage and refuse collection and disposal fees assessed in Exhibit A attached to and made a part of a proposed resolution entitled A Resolution of the City Council of the City of Maricopa Approving the Manner of Collection of Delinquent, Current and Future Garbage and Refuse Collection and Disposal Fees. 4) Close Public Hearing re Collection of Maricopa Garbage and Refuse Collection and Disposal Fees on County Tax Roll
5) Council discussion re Collection of Maricopa Garbage and Refuse Collection and Disposal Fees on County Tax Roll
6) Motion to adopt resolution entitled A Resolution of the City Council of the City of Maricopa Approving the Manner of Collection of Delinquent, Current and Future Garbage and Refuse Collection and Disposal Service Fees

BACKGROUND
NOTE: The City Attorney has determined that a two thirds vote is necessary to adopt a resolution authorizing collection of refuse collection and disposal service fees by the County Tax collector. Thus, the proposed resolution must be adopted with at least four votes if the city is to collect refuse collection and disposal service fees by assessment through the County Tax Collector.

Section 5473 of the California Health and Safety Code allows cities providing garbage and refuse collection and disposal services to place fees for such service on the county tax rolls and to have such fees collected by the county tax collector at the same time and in the same manner as other taxes are collected. The city of Maricopa has traditionally collected both sewer service fees and refuse collection and disposal fees in this manner.

Many, if not most, cities avail themselves of this option by executing an agreement with the county tax collector authorizing such action and by adopting an annual resolution assessing the appropriate fees and authorizing the county tax collector to bill for and collect those fees as noted above. This spares the cities the expense of establishing what is essentially a retail billing and collection operation and it assures that all fees are ultimately collected since failure to pay will eventually result in sale of delinquent properties.

Attached hereto is a report containing the description of each parcel of property receiving garbage and refuse collection and disposal service from the city of Maricopa and the amount of the garbage and refuse collection and disposal fee for each parcel for the fiscal year beginning July 1, 2018 and ending June 30, 2019 computed in conformity with the city's garbage and refuse collection and disposal fee resolution adopted by the City Council, the said report being attached to and made a part of a proposed resolution entitled A Resolution of the City Council of the City of Maricopa Approving the Manner of Collection of Delinquent, Current and Future Garbage and Refuse Collection and Disposal Fees authorizing the collection of such fees by the Kern County Tax Collector. . After the county receives the city's resolution, a similar resolution directing the tax collector to proceed is adopted by the county Board of Supervisors. The deadline for submitting this resolution to the county is August 9, 2024 which is before the city's next regularly scheduled Council meeting on August 13, 2024 which means that this is the last chance for Council to act on this matter prior to the August 9 deadline.

Attached hereto is the proposed resolution including authorizing the County Tax Collector to collect the subject fees including Exhibit A which designates the parcel numbers to which the rates apply and the fee for each parcel.

Staff recommends that Council conduct the Public Hearing advertised for this time and date and, after receiving comments, protests and objections to assessments specified in in Exhibit A, to close the Public Hearing and conside a motion to adopt resolution entitled A Resolution of the City Council of the City of Maricopa Approving the Manner o Collection of Delinquent, Current and Future Garbage and Refuse Collection and Disposal Fees.

BACKGROUND
NOTE: The City Attorney has determined that a two thirds vote is necessary to adopt a resolution authorizing collection of sewer collection and disposal service fees by the County Tax collector. Thus, the proposed resolution must be adopted with at least four votes if the city is to collect sewer collection and disposal service fees by assessment through the County Tax Collector.

Section 5473 et seq of the California Health and Safety Code allows cities providing sanitary sewer service to place fees for such service on the county tax rolls and to have such fees collected by the county tax collector at the same time and in the same manner as other taxes are collected.

Attached hereto is a report containing the description of each parcel of property receiving sanitary sewer service from the city of Maricopa and the amount of the sewer service fee for each parcel for the fiscal year beginning July 1, 2024 and ending June 30, 2025 computed in conformity with the city's sewer service fee ordinance adopted by City Council, the said report being attached to a proposed resolution entitled A Resolution of the City Council of the City of Maricopa Approving the Manner of Collection of Delinquent, Current and Future Sewer Service Fees as Exhibit A authorizing the collection of delinquent, current and future sewer service fees by the Kern County Tax Collector.

After the county receives the city's resolution, a similar resolution directing the tax collector to proceed is adopted by the county Board of Supervisors. The deadline for submitting this resolution to the county is August 9, 2024 which is prior to the city's next regularly scheduled Council meeting on August 13, 2024 which means that this is the last chance for Council to act on this matter prior to the August 9 deadline.

Attached hereto is the proposed resolution authorizing the County Tax Collector to collect the subject fees. Attached to the resolution is Exhibit A which designates the parcel numbers to which the rates apply and the fee for each Staff recommends that Council conduct the Public Hearing advertised for this time and date and, after receiving comments, protests and objections to assessments specified in in Exhibit A, to close the Public Hearing and consider a motion to adopt resolution entitled A Resolution of the City Council of the City of Maricopa Approving the Manner of Collection of Delinquent, Current and Future Sewer Service Fees City Adm.
