Steve Albritton Dear Mayor Smith:

Karen Banks
The California Constitution requires that a grand jury be "drawn and Donalda Biscar summoned at least once a year in each county." The first Kern County Grand Jury was seated by the Board of Supervisors in 1867 to investigate the Steve Bowles
conditions of the jail. For over 155 years, the citizens of Kern County have Gary Chaffin served on the Grand Jury.

Kelly Hukill
The Grand Jury needs representatives for all segments and areas of the Bernard Johnson
County to serve on the Jury for a one-year term. The Grand Jury is asking Lydia McClure each city and the County Board of Supervisor to help the residents of the County to become more aware of the role of the Grand Jury by declaring Clara Medrano
February 2025 as Ker County Grand Jury Awareness Month.

Thomas Pasek
Please ask the City Council to proclaim this Grand Jury Awareness Month, Kahlil Ramzan
and help the Jury celebrate in the many activities scheduled. You are invited Alfredo Robledo to attend the Awareness Ceremonies on February 4, 2025, in front of the Jacqueline Thomas Kern County Superior Court Building, 1415 Truxtun Avenue, Bakersfield, California beginning at 12 noon and an open house in the Jury Chambers on Debra Verdugo

PROCLAIM FEBRUARY 2025 AS SAFELY SURRENDERED BABY

AWARENESS MONTH IN MARICOPA
(Fiscal Impact: None)
The purpose of this letter is to ask the Maricopa City Council to proclaim February 2025 as Safely Surrendered Baby Awareness Month and to advise the community of planned events to highlight the importance of the Safely Surrendered Baby Law.

The Safely Surrendered Baby Law responds to the increasing number of newborn infant deaths due to abandonment in unsafe locations. First created in January 2001, the law's intent is to save the lives of newborn infants at risk of abandonment by encouraging parents or persons with lawful custody to safely surrender the infant within 72 hours of birth, with no questions asked. Since 2006, Kern County has had 103 babies safely surrendered.

In Kern County, a newborn baby can be safely surrendered into the hands of any hospital emergency room or Fire Station staff. The Safely Surrendered Baby Coalition, under the coordination of the Department of Human Services, works to educate Kern County residents about this important law.

The coalition is led by the Department of Human Services, and includes a group of dedicated individuals representing a long list of agencies, non-profits, hospitals, and stakeholders, including First Five Kern, the Kern County Fire Department, Bakersfield City Fire Department, Bakersfield Pregnancy Center, Right to Life Kern County, Adventist Health Hospitals, Clinica Sierra Vista, Kern Family Healthcare, Koinonia Family Services, Kern County Public Health, and Ridgecrest Regional Hospital.

Our February Awareness Campaign will include, a Live Press Conference February 13, 2025 at Adventist Health Specialty located at 3100 Sillect Ave, Bakersfield CA 93308 beginning at 9:00am, over 15 presentations at collaborative agencies throughout Kern County and Public Services Announcements on social media, all in an effort to alert the community about the Safely Surrendered Baby Law as a much better option than abandoning a baby.

Therefore, IT IS RECOMMENDED that your Board proclaim February 2025 as Safely Surrendered Baby Awareness Month, prepare a proclamation and make presentation.

Sincerely,
Kristy Torres
Human Services Program Specialist

TITLE: Adopt Amendment to Agreement Between City of Maricopa and BHT Engineering Inc for Engineering Design Services for Maricopa City Park Improvement Program Department of Parks and Recreation Grant Contract C9801018, Project No. SW-15-004 and to Authorize Mayor and City Clerk to Execute the PROPOSED BY: Eric G Ziegler
MEETING DATE: February 11, 2025

RECOMMENDATION
Motion to Adopt Amendment to Agreement Between City of Maricopa and BHT Engineering Inc for Engineering Design Services for Maricopa City Park Improvement Program Department of Parks and Recreation Grant Contract C9801018, Project No. SW-15-004 and to Authorize Mayor and City Clerk to Execute the Agreement on Behalf of the City.

BACKGROUND
In July, 2019 Council approved an Application for Statewide Park Development and Community Revitalization Program Grant Funds for development of the Maricopa Park Expansion Project.

The grant application sought funding in the amount of $1,924,746 to expand the existing Maricopa Park by developing 2.35 acres (APN# 042-154-04-00-0 / 042-154-06-00-6 / 042-174-01-00-7) previously donated by Aera Energy, LLC., and constructing a new rubberized asphalt bike pump track, shade structure, walking path, restrooms, public art, parking lot, lighting throughout and also renovating the two existing playgrounds; and In February, 2020 the city's grant proposal was selected for funding in the requested amount of $1,924,746.

Subsequently the city released a Request for Proposal ("RFP") for Landscape Architect/Engineering Design Services Maricopa City Park Improvement Program Department of Parks and Recreation Grant Contract 9801018, Project No. SW-15-004 Deadline for submittals was July 29, 2021.

Notice of the RFP dated June 28, 2021 was published in the Fresno Bee, Bakersfield Californian, Taft Midway Driller (adjudicated newspaper of general circulation in the Maricopa area, Antelope Valley Press; it was also sent to Kern County Builders Exchange, Tulare and Kings County Builders Exchange, Santa Maria Valley Contractors Association, Central California Builders Exchange, San Luis Obispo County Builders Exchange, Dodge Data and Analytic Company.

By mid to late July, the city had few inquiries seeking plans and specs to prepare proposals for this project. Thus, the city elected to extend the deadline for responses to its RFP. Notice of the Extended Deadline for Response to the RFP dated July 26,2021 was published/distributed through the same channels noted above. This was a 14-day extension with an amended response date of August 12, 2021.

At the close of the August 12, 2021 response deadline, one response had been received, that being the response of BHT Engineering of Bakersfield. Since BHT Engineering had no experience in design and construction of Bicycle Pump Tracks, the signature feature of the park project and was addressed in the city's RFP, BHT subcontracted the pump track design to American Ramp Company, an experienced pump track designer and builder.

The sole RFP response was sent to three qualified evaluators, each of whom evaluated the proposal on a pre-published score sheet. The three evaluators scored the proposal 94, 84, 97 respectively; and Because the city's RFP evoked only one response, staff checked with the Parks Department's Grant Administrator to determine whether awarding the contract to a sole respondent to an RFQ/RFP complied with the department's procurement policies and procedures. The city was told that if the procurement process was consistent with the city's procurement policy, they had no issue with a sole response contract
In October, 2021, City Council awarded a contract to BHT Engineering Inc for Engineering Design Services, for the Maricopa City Park Improvement Program, Department of Parks and Recreation Grant Contract C9801018, Project No. SW-15-004 at a cost $259,730.

Shortly after the grant contract was signed, the COVID pandemic struck. Given Maricopa's small size, and limited resources, the park program languished during the COVID scare. Inflation during and after the pandemic led to a situation in which the original Park Grant was insufficient to successfully pursue the project as originally conceived. Lack of additional funding through the city led to a Parks Department approved reduction in scope of the project. Wanting to complete the project as originally conceived, the city applied for and was awarded a Clean California Grant through Cal Trans in the amount of $2,103,000. The Cal-Trans Grant allows the city to restore certain improvements to the Project that had been eliminated previously due to budget concerns.

In order to get the Park Improvements back on track, the city must now procure design services for the project enhancements contemplated in the CalTrans grant application.

The city believes that it complied with CalTrans procurement policies and procedures in awarding the original contract for Engineering Design Services for the Maricopa City Park Improvement Program Department of Parks and Recreation Grant Contract C9801018, Project No. SW-15-004 agreement. Given that the BHT design contract for this project is an open contract, meaning that it is still active, and given the real world problems associated with actually constructing a project tonguering t parts of which have been designed by two different engineering firms, the city is proposing to proceed in completing the design for the project by amending the current design agreement with BHT by amending, modifying, or altering certain terms and conditions of the existing Agreement referenced herein in order to effectively design the both the original Parks Department funded Project along with the Project Enhancements funded by the CalTrans grant In this scenario, the city would execute the proposed Amendment, BHT would design the Project Enhancements under the amended Agreement maintaining separate records and submitting separate billings for each grant. The city would then pay the bills and submit billings to the individual grantor for reimbursement.

There is an element of risk with this approach, that being the potential for a disagreement between CalTrans and the city concerning the procurement process. In that event, CalTrans may deny reimbursement for engineering expenses associated with the CalTrans funded Project Enhancements. In that event, the city may be responsible for bearing those engineering costs which the amendment caps at $75,000. Although this is no small amount, it is doable and the denial of engineering cost reimbursement, should it occur, in no way compromises the city's ability to complete the full project with grant funds.

Should the city not complete the project as proposed, the city would be required to reimburse each grantor for funds spent to that point. That amount, including the pump track currently under construction is approximately $1,000,000 to date.

Given where we are in this project, limited exposure to risk of loss ($75,000) in the procurement phase of the CalTrans grant, limited time to complete construction of the project and the financial consequence of failing to perform, staff recommends the Council favorably consider a motion to Adopt Amendment to Agreement Between City of Maricopa and BHT Engineering Inc for Engineering Design Services for Maricopa City Park Improvement Program Department of Parks and Recreation Grant Contract C9801018, Project No. SW-15-004 and to Authorize Mayor and City Clerk to Execute the Agreement on Behalf of the City.

Attached hereto is a timeline for advancing the Park Improvement Project assuming that Council adopts the proposed amendment to the design engineering agreement.

WHEREAS, Notice of the RFP dated June 28, 2021 was published in the Fresno Bee, Bakersfield Californian, Taft Midway Driller (adjudicated newspaper of general circulation in the Maricopa area, Antelope Valley Press; it was also sent to Kern County Builders Exchange, Tulare and Kings County Builders Exchange, Santa Maria Valley Contractors Association, Central California Builders Exchange, San Luis Obispo County Builders Exchange, Dodge Data and Analytic Company; and
WHEREAS, Notice of Extended Deadline for Response to the RFP dated July 26, 2021 was published/distributed through the same channels noted in the above referenced recital. This was a 14 day extension with an amended response date of August 12, 2021; and WHEREAS, at the close of the August 12, 2021 response deadline, one response had been received, that being the response of BHT Engineering of Bakersfield. The sole RFP was sent to three qualified evaluators, each of whom evaluated the proposal on a pre-published score sheet.

The three evaluators scored the proposal 94, 84, 97 respectively; and WHEREAS, Because the CITY's RFP evoked only one response, the CITY checked with the Parks Department's Grant Administrator to determine whether awarding the contract to a sole respondent to an REFQ/RFP complied with the department's procurement policies and procedures. The CITY was told that if the procurement process was consistent with the CITY's procurement policy, they had issue with the process; and WHEREAS, On October 26, 2021, City Council awarded a contract to BHT Engineering Inc for Engineering Design Services, for the Maricopa City Park Improvement Program, Department of Parks and Recreation Grant Contract C9801018, Project No. SW-15-004 at a cost $259,730. ("The Agreement "); and
WHEREAS, Shortly after the grant contract was signed, the COVID pandemic struck. Wanting to complete the project as originally conceived, the CITY applied for and was awarded a Clean California Grant through Cal Trans( "Cal- Tran Grant) " and WHEREAS, The Cal-Trans Grant allows for the CITY to restore certain improvements to the Project that had been eliminated previously due to budget concerns collectively (the "Project Enhancements"); and
WHEREAS CITY wishes to avoid potential conflict arising from attempting to integrate design elements prepared by multiple parties into a single coherent project; and WHEREAS CITY has complied with CALTRANS procurement policies and procedures in awarding the original contract for Engineering Design Services for the Maricopa City Park Improvement Program Department of Parks and Recreation Grant Contract C9801018, Project No. SW-15-004 agreement; and
WHEREAS, CITY and CONSULTANT mutually desire to amend, modify, or alter certain terms and conditions of the Agreement referenced herein in order to effectively design the Project along with the Project Enhancements.

MEETING DATE: February 11, 2025

RECOMMENDATION

BACKGROUND
On May 14, 2019., the City of Maricopa entered into an Agreement between the City and BHT Engineering, Inc. for professional engineering services commonly required by municipal governments.

Specifically, BHT was engaged to provide on-call or as needed engineering services including, but not limited to, reviewing public infrastructure improvement and grading plans in support of City's building and planning activities; providing subdivision map and plan check assistance to the City's planning and building functions; performing certain design, surveying, drafting and cost estimation services; developing plans and specifications necessary to advance certain projects to design and construction; providing certain professional services that may be required during the bid process and construction of various public projects.

To the extent that services requested from BHT Engineering during the term of this Agreement as Amended arise from city sponsored projects such as street and highway issues, sewer issues and similar, the city is will bear project costs as specified in Exhibit A; to the extent the need for such services arise from private sector interests such as land use issues, subdivision maps issues etc., cost will be borne by the requesting party with deposit required before work is performed.

Given that the City Attorney has reviewed and approved this agreement, staff recommends that Council favorably consider a Motion to Approve Amendment to Professional (Engineering) Services Agreement Between City of Maricopa and BHT Engineering, Inc. and Authorize Mayor and City Clerk to Execute the Amendment on Behalf of the City.

AGENDA ITEM
TITLE: Discuss/Provide Direction re Acquisition of Truck for Public Works Department PROPOSED BY: Eric G. Ziegler
MEETING DATE: February 11, 2025

RECOMMENDATION
Staff recommends that Council authorize staff to acquire used vehicle suitable for towing Jetting Machine Trailer, at a price not to exceed $30,000 before title and registration fees.

BACKGROUND
Over the years, the city has been fairly successful in satisfying its vehicular needs by acquiring used vehicles on the open market rather than by acquiring new vehicles. The last vehicle acquired by the city in this manner was a 2010 Ford F150 acquired for $18,980 in August, 2018. A quick check of a new Ford F150 in 2023 was approximately $66,000 which is a bit much given the city's financial circumstance.

The city also acquired a 1998 Ford Ranger pick-up truck which currently has 138,000 + /- miles on its broken odometer. This vehicle was purchased over 15 years ago from the City of Santa Barbara, and has been used steadily by the Public Works Department.

In July of 2024 the city purchased a Jetting Machine Trailer Unit, that is used to clean out obstructed city sewer lines and is also used to provide general maintenance of the regular sewer lines to catch potential issues, with the likelihood of preventing blockages before they happen.

The weight of the Jetting Machine is approx. 3,200lbs and the 300-gallon water tank on board, when full is an additional 2,499 pounds, a combined weight totaling 5,699 +/- Ibs. The Max towing capacity of the 2010 F150 is 5,000 Ibs. per the 2010 F-150 owners guide.

The "80 Rule for Towing" states you should never exceed 80 percent of your vehicle's max tow capacity, which is set by the vehicles manufacturer. Towing a trailer that weighs more than the max towing capacity of a vehicle, can greatly shorten the life of the tow vehicle by causing excessive wear and tear to the vehicle such as strain and damage to the engine and transmission, excessive break wear, damage to the vehicle's chassis and/or axle and could lead to break failure resulting in damage to property or serious personal injury.

In the past few weeks, it has been brought to the attention of Staff that there has been a noticeable strain on the F150 in its ability to handle the fully loaded weight of the Jetting Machine, and for the safety of the employee(s) and the general public, Staff believes it is in the best interest of the city to acquire a vehicle suitable for pulling the Jetting Machine.

Staff recommends that Council authorize staff to explore the used vehicle market for a suitable truck for the Public Works Department and to present multiple vehicles to the Council for consideration of acquisition, to an F250 or equivalent, with a tow capacity to pull Jetting Machine Trailer safely.

AGENDA ITEM
TITLE: Appointment of City Selection Committee Member and Alternate Member PROPOSED BY: Eric G. Ziegler
MEETING DATE: February 11, 2025

RECOMMENDATION

1. Motion to appoint Mayor Cory Morse as the City of Maricopa's member of the Kern County City Selection Committee.

2. Motion to confirm Mayor Morse's appointment of an alternate member of the Kern County City Selection Committee.

BACKGROUND
Staff has received correspondence from the San Joaquin valley Air Pollution Control District (SJVAPCD) asking that Council appoint a member to the City Selection Committee. Apparently this request is being made in anticipation of a meeting of the City Selection Committee at some future date. Given that the composition of the City Selection Committee is specified in law, this seems like a meaningless exercise. However, in deference to the APCD, staff is recommending that Council conduct a vote on City Selection Committee representatives and that a certified copy of the minutes reflecting the vote be submitted to the Clerk of the APCD Board for the record.

The City Selection Committee is addressed in Section 50270 et seq, California Government code which states in part:
"In any county in which two or more cities are incorporated there is hereby created a city selection committee the purpose of which shall be to appoint city representatives to boards, commissions, and agencies as required by law. The membership of each such city selection committee shall consist of the mayor of each city within the county." Thus, by operation of law, the mayor, in this case Mir. Morse, is designated as the city's member of the City Selection Committee.

Government Code Section 50271 requires appointment of an alternate member to the City Selection Committee:
"When the mayor is unable to attend a meeting of a city selection committee, the mayor shall designate another member of the city's legislative body to attend and vote at the meeting as the mayor's representative."
As noted above, it is the mayor's responsibility to designate an alternative in the event the mayor is unable to attend a scheduled committee meeting. This being the case, it is appropriate for Mayor Morse to designate and for council to confirm the appointment of one council member as the city's alternate member of the Kern County City Selection Committee.
