Just prior to the start of Construction it was discovered that due to the location of an existing guy-wire, the track would need to be rotated in order to ensure a safe buffer between the track edge and the guy wire.

Due to the existing elevations of the site, this rotation required that an estimated 1,650 cubic yards in addition to the originally planned excavated materials be dug out. In order to properly grade the site this additional material also needed to be hauled off.

Also, during excavation it was discovered that there were pockets of asphalt within the subgrade which were not originally identified. This uncovered asphalt will be hauled away along with the additional excavated soils as part of this Change Order.

Loading and hauling of additional excavated soil and asphalt $4,480.00 Total Change Orders: = $4,480.00

RECOMMENDATION
1) Motion to waive reading of an ordinance Entitled an Urgency Ordinance of the City Council of the City of Maricopa Amending the Maricopa Municipal Code by Adding Chapter 12.12 Establishing Rules and Regulations for Operation and Use of the City's Bicycle Pump Track at Maricopa City Park
2) Motion to adopt an ordinance Entitled an Urgency Ordinance of the City Council of the City of Maricopa Amending the Maricopa Municipal Code by Adding Chapter 12.12 Establishing Rules And Regulations for Operation and Use of the City's Bicycle Pump Track at Maricopa City Park

BACKGROUND
At the regularly scheduled meeting of Tuesday, March 25, 2025, Council discussed the possibility of a "soft opening" of the recently completed pump track at Maricopa City Park. In order for this to occur, among other things, the city must adopt an ordinance establishing rules and regulations for operation and use of this facility. Typically, it takes 45 to 60 days to adopt such an ordinance.

In order to expedite the opening of this facility, staff recommends that Council adopt the urgency ordinance attached hereto. If adopted by a 4/5 vote, the ordinance will become effective immediately and remain in effect for a period of 45 day. During those 45 days, Council will have adequate time to introduce and adopt a standard ordinance which should be in full force and effect by the time the urgency ordinance expires. A subsequent item on this agenda will begin that process by introducing the proposed ordinance.

Accordingly, staff recommends that Council favorably consider motions to 1) Waive reading of an Ordinance Entitled An Urgency Ordinance of the City Council of the City of Maricopa Amending the Maricopa Municipal Code by Adding Chapter 12.12 Establishing Rules And Regulations for Operation and Use of the City's Bicycle Pump Track at Maricopa City Park; 2) Adopt Ordinance Entitled An Urgency Ordinance of the City Council of the City of Maricopa Amending the Maricopa Municipal Code by Adding Chapter 12.12 Establishing Rules And Regulations for Operation and Use of the City's Bicycle Pump Track at Maricopa City Park.
